Judge Orders Hearing on the Vaad Hakohol Elections Matter

CROWN HEIGHTS, Brooklyn [CHI] – Lawyers representing both the old and new Vaad’s appeared in court yesterday, and each left with the feeling that they were victorious. In arguments the judge dismissed the initial action attempting to bar the elections from taking place altogether, saying it was moot since the elections have already taken place. But the judge ordered a hearing on an action contesting the “legality and validity” if the entire election process.

No Restraining Order, Both Groups Sitting in the Offices

CROWN HEIGHTS, Brooklyn [CHI] — Lawyers for the Lang Vaad appeared today in court for a arguments on the matter of the Temporary Restraining Order, which they wanted to have reinstated until the hearings on June 3rd on the matter of elections.

In an appearance before the lower courts the judge turned down the request, the then scene repeated itself again in appeals court with the judge turning down the request. The original date set for June 3rd still stands and both parties can be in the office until then.

THE REAL CROWN HEIGHTS ELECTION RESULTS

CROWN HEIGHTS, Brooklyn [CHI] — Sunday night we reported the election tally, but that was hardly a reflection of the real outcome of the elections. Monday afternoon and Today, Tuesday the new Vaad began their tenure by taking control of the Community Council and Vaad Hakohol Offices by force, in a massive display of Chilul Hashem, and the opposite of which these bodies are to represent.

Both parties clashed in a spar of verbal assaults and the removal of people from the offices by force. Property was damaged and windows were broken, as members of the opposing factions tried to change locks while others attempted to hold possession of the premises.

For the Vaad the following were voted in: 719 – Fishel Brownstein, 639 – Chanina Sperlin, 594 – Elie Poltorak, 513 – Zev Cadaner. The following were not voted in: 421 – Yaacov Rogalsky, 416 – Yossel Mochkin, 311 – Mendel Shagalov, 282 – Yossi Keller, 220 – Zaki Tamir, 208 – Avraham Bialestock.

Poltorak Threatens Berger with Sanctions for Disseminating Misinformation

Dear Mr. Berger,

This shall serve as a response to your letter addressed to Dr. Lang but distributed to my clients and the community at large. Your letter is patently false and a blatant attempt to intimidate my clients and sow confusion in the community with respect to the upcoming elections.

As you well know, I appeared in the Appellate Division pro se, as well as on behalf of all of the other Respondents—except for Zaki Tamir and those represented by Mr. Rudofsky. This is reflected in the RADI form and was clearly stated during our conference with the court attorney.

Attorney David Berger Explains what happened in Court

Dear Dr. Lang:

You asked me for an advisory opinion about the current status of the Injunction (T.R.O.) that we obtained tins past Wednesday restraining tile Sunday elections called by Yisroel Best, as well as tile lawsuit in general as it pertains to the elections.

With regard to the injunction, the Appellate Division yesterday issued a “stay” of the “TRO” to the four persons who appealed, those being Respondents Yisroel Best, Yisroel Sandhaus, Yisroel Landau and Eli Poltarok. As none of the other 14 Respondents (candidates) appealed the injunction, a very strong argument can be made that the Appellate Division’s Order does not protect or apply to them. The other 14 Respondents are: Kalman Bialestock, Fishel Brownstein, Zev Cadaner, Yossi Keller, Yossel Motchkin, Yaacov Rogalsky, Mendel Shagalov, Chanina Sperlin, Zaki Tamir, Uri Niazov, Gershon Chaimson, Motel Chein, Zalman Lipsker, and Y. Boruch Spielman.

Appellate Division Election Order Applies To All

Attorney David Berger’s statements regarding the Order issued by the Appellate Division, regarding the election tomorrow, are unfortunately mistaken. All of the respondents were represented at the Appellate Division. I appeared for Yisroel Best, Yisroel Sandhaus and Yisroel Landau. Elie Poltarak, who is also an attorney, appeared on his own behalf and on behalf of all of the other respondents. Thus, everyone was represented and is without doubt the beneficiary of the Appellate Division Order which stayed the TRO issued by the lower court the previous day. Anyone who doubts the above should go to the Court and check the Request for Appellate Division Intervention (RADI) form, which clearly identifies the parties and their attorneys.

Restraining Order Stayed in Appeal, Elections Back On

CROWN HEIGHTS, Brooklyn [CHI] — Arguments before the State Appellate Court was heard a short while ago and judge Daniel Angiolillo granted a stay of the Temporary Restraining Order which barred the elections from taking, clearing the way for the elections to still take place.

Contrary to rumors which have been spreading, the victory in court today only reflected on the TRO that was granted yesterday, which was the only item that was contested. The case is still set to be heard on June 3rd in which the merits of the case will be argued.

Judge Grants Restraining Order – Elections Canceled

BROOKLYN, NY [CHI] — CrownHeights.info just received word from Brooklyn Supreme Court that a judge granted the temporary restraining order (TRO), barring the election from taking place. This comes after the election candidates were served with a court order last night. The judge granted the restraining order till June 3rd, when a hearing will be held.

Zaki Tamir Announces His Resignation from the Elections, Citing Psak Din

At 10:30 this morning one of the candidates running for the Elections in the Vaad Hakohol announced his resignation citing the Psak Din, which we reported on early this morning.

His announcement stated: “With much disappointment I regret to inform you that last night (5/19/09) I received a Psak Din (dated 5/18/09) prohibiting my involvment with the upcoming elections. The Psak labels the election as Illegal. Considering that Unity and Humility must (at times) come before freedom, I beg the apology of all the people that supported me and all the caring hearts that yearned swift change. I hereby announce my resignation from candidacy to the CHJCC.”

Election Candidates Served with Psak Din and Court Order

CROWN HEIGHTS [CHI] — In a new development all the candidates for Vaad Hakohol and Gaboim, as well as the disputed members of the Netzigim; were served with a notice to appear in Supreme Court tomorrow afternoon, for a hearing on a motion by the current Vaad to block the elections.

The following is a letter that was released late last week by Rabbi Avrohom Osdoba clarifying his position regarding the upcoming elections for the Vaad Hakohol and Gaboim. In response Rabbi Aharon Yaakov Schwei redistributed his letter from the last elections. To the members of the community,

I would like to clarify my position regarding holding the elections, that have been discussed lately.

In my opinion one should not vote in these elections (for Vaad Hakohol etc and Gaboim) for the simple reason: the idea of elections is to give an equal opportunity to upstanding and honest individuals to be elected to the important role of Gaboim and community activists. In the present situation there is no possibility to maintain this fundamental provision.

OUTRAGE: Drop your Child off at Beis Rivka, Get a Double Parking Ticket!

CROWN HEIGHTS, Brooklyn [CHI] — For the second day in a row police have been issuing double parking tickets to parents who stopped their cars near Beis Rivkah and dropped off their kids. One observer noted that yesterday, Wednesday, the police car that usually pulls over cars from making the right turn was standing on the other side of the intersection waiting for the cars to double park then issued them the $115 tickets.
