As alleged in the lawsuit, Kingston’s zoning ordinance violates RLUIPA because it requires that places of worship obtain discretionary special exception use permits, while comparable nonreligious assembly uses like theaters, bowling alleys, recreational facilities, and libraries are permitted as of right.
