Dear Dr. Lang:

You asked me for an advisory opinion about the current status of the Injunction (T.R.O.) that we obtained tins past Wednesday restraining tile Sunday elections called by Yisroel Best, as well as tile lawsuit in general as it pertains to the elections.

With regard to the injunction, the Appellate Division yesterday issued a “stay” of the “TRO” to the four persons who appealed, those being Respondents Yisroel Best, Yisroel Sandhaus, Yisroel Landau and Eli Poltarok. As none of the other 14 Respondents (candidates) appealed the injunction, a very strong argument can be made that the Appellate Division’s Order does not protect or apply to them. The other 14 Respondents are: Kalman Bialestock, Fishel Brownstein, Zev Cadaner, Yossi Keller, Yossel Motchkin, Yaacov Rogalsky, Mendel Shagalov, Chanina Sperlin, Zaki Tamir, Uri Niazov, Gershon Chaimson, Motel Chein, Zalman Lipsker, and Y. Boruch Spielman.

Appellate Division Election Order Applies To All

Attorney David Berger’s statements regarding the Order issued by the Appellate Division, regarding the election tomorrow, are unfortunately mistaken. All of the respondents were represented at the Appellate Division. I appeared for Yisroel Best, Yisroel Sandhaus and Yisroel Landau. Elie Poltarak, who is also an attorney, appeared on his own behalf and on behalf of all of the other respondents. Thus, everyone was represented and is without doubt the beneficiary of the Appellate Division Order which stayed the TRO issued by the lower court the previous day. Anyone who doubts the above should go to the Court and check the Request for Appellate Division Intervention (RADI) form, which clearly identifies the parties and their attorneys.

Car Burst into Flames on Eastern Pkwy

CROWN HEIGHTS [CHI] — Later afternoon Friday a car driving on Troy Ave and Easern Pkwy burst into flames. The incident happened as the vehicle, driven by a Black male was coming up onto the intersection of Eastern Pkwy from Troy Ave. He saw smoke coming out of his hood, and quickly pulled over and called 911.

Truck Hits Boy on Empire Blvd

CROWN HEIGHTS [CHI] — Friday afternoon as people were getting ready for shabbos, a boy escaped from his mothers arms and was hit by a truck. The incident took place near the supermarket on Empire Blvd and Albany Ave. The boy who was holding his mothers hand, slipped free for a minute and was hit by a truck.

BROOKLYN, NY — At least 20 students, around ages 11 to 15, were injured around 10:30 a.m. on Friday when a grate gave way under them outside a Brooklyn school, causing them to fall into a basement, the authorities said. Fifteen students were taken to Maimonides Medical Center, according to the Fire Department, and an assemblyman said that other injured students were taken to New York Methodist Hospital and Lutheran Medical Center.

BROOKLYN [NEWS12] — Synagogues in Brooklyn are taking increased security measures after news of an alleged terror plot to bomb two centers in the Bronx.

Patrols have been placed outside the Congregation of B’Nai Avraham. The synagogue’s leader, Rabbi Raskin, says the beefed-up security is necessary.

TVERIA, ISRAEL [CHI] — In conjunction with today’s Siyum of the yearly learning of Rambam, Crownheights.info has obtained photos of a new film being produced by Malka Touger (Producer of the videos I Am A Chassid and Hand in Hand) in collaboration with JEM. The new Rebbe video for kids is reported to be a tour through special sites of Chassidic interest in Eretz Yisroel, woven together with the Rebbe’s words about them.

To Count is not to be Counted Upon – Dependability Determines Self Worth

It was the Baal Shem Tov’s custom to draw out his prayers on Friday evenings. His disciples, who typically finished before him, would wait for their Rebbe to conclude, so that they may join him in the Shabbos meal.

It happened, on a given Friday, that one of the participants felt rather hungry. He thought to himself: “There is still plenty of time before the Baal Shem Tov will complete his prayers; I ought to go and eat something. In all likelihood, I will be back before he’s done. Besides, there are plenty of others around; I shall certainly not be missed.”

Seeing him slip out the door, another fellow decided to do the same. This started a chain reaction and soon the Baal Shem Tov was left to himself. Imagine their embarrassment, when, upon their return, they found their Rebbe sitting all alone waiting for them.

The Baal Shem Tov lovingly explained to them that a head is only as high as the body on which it rests. He said that his ability to stay “up there,” and function as their head, depended entirely on the degree of their individual and collective commitment.
