Cops Tackle, Mace Father Inside Beis Rivkah

The father of a Beis Rivkah student was on his way to drop off doughnuts at his daughter’s class for her birthday this morning, when a confrontation with police led to him being tackled and maced in front of several horrified parents, teachers and young students.

The incident began to unfold today, Thursday, at around 9:00am. According to witnesses, the man had parked his car and was heading toward the school’s main entrance, when a police officer accosted him and accused him of having committed a traffic violation.

The man denied the charges and refused to present his driver’s license to the officer, at which point the officer demanded that he place his hands behind his back as he was placing him under arrest.

Instead of complying, the man entered the school building, where witnesses saw him standing in the stairwell and holding the handrail, refusing the police officer’s orders to give him his hands.

Witnesses clarified that the cop was alone while trying to make the arrest, with his partner more than halfway down the block in the midst of another traffic-stop, rendering him unable to subdue the suspect.

Meanwhile, inside the school, things were escalating quickly and getting louder, all while dozens of parents were dropping off their children for the school day. By the time the officer was joined by his partner, the confrontation had moved into the school’s hallway, near the young girls’ classrooms.

Cell phone video obtained by CrownHeights.info shows one officer – who had no idea what had led to the confrontation – attempting to reason with the man, saying: “we can do this the right way or the wrong way.”

The altercation persisted for nearly ten minutes, as it migrated from the hallway into the glass atrium – which serves as the main entrance for parents pushing a wagons or strollers. There, the officer who had originally stopped the man got fed up and sprayed the man with mace.

Everyone in the vicinity, including both officers and a witness who was filming the incident, teared and choked up from the mace.

The man was then cuffed and hauled off to the 71st Precinct for booking.

Was the Situation Avoidable?

Questions persist as to why the officer approached the man for a “traffic stop” alone, which seems to be a departure from police procedure and allowed for the situation to escalate and migrate into a school building with young children inside.

A spokesman for the 71st Precinct told CrownHeights.info that while it isn’t recommended for safety reasons, approaching an offender alone is not a violation of police procedure per se.

One bystander had his own theory: “Cops are on a mission to pull over as many cars as they can and at any cost, even if it means putting people in danger, which is why they split up,” he said.

Benjy Stock, the administrator of Beis Rivkah, told CrownHeights.info: “Police cooperate with us very well; whenever we need them they are always there within minutes. I don’t know what happened in this case, and therefore cannot comment.”

    As someone who was standing on the corner waiting to cross i heard the police ask for his license and registration to which the man responded i do not have it. The cop did not ask him to put his hands on the car so he could be arrested but wanted to speak to him and the man immediately ran into the school. The police may have been wrong in stopping him but one thing is certain you NEVER run away from the police you only make matters worse for you.

      Why should he comply? It’s a free country, and we are not slaves of the police, to have to obey their orders. They are our servants, not the other way around. If the policeman actually witnessed him an offense, then he had the right to give him a ticket if he had ID on him, or to arrest him if he didn’t. But if (as the man seems to have claimed) he didn’t see an offense, because there wasn’t one to see, then he had no business demanding ID or anything else.

      Milhouse, the police are supposed to ENFORCE the law. That said, citizens are supposed to OBEY the law. Are we clear so far? Good. Therefore, if a police officer accuses a citizen of BREAKING the law, said law demands that a judge/jury decide who is at fault and who isn’t. In this case, the police officer accused a citizen of breaking the law. If the citizen disagrees with the charges, it’s his lawful right to challenge them in a court of law. By failing to submit to an arrest, he was not only breaking the law, but breaking the law in a visibly aggravated, documented manner thanks to whomever recorded the incident.

      FYI, any time a peace officer pulls you over, it is a form arrest. In this case, the man was accused of a crime that an officer claimed to have witnessed. That in and of itself is cause for arrest. If the case goes to court, both parties will have to testify and present evidence pertinent to their respective claims. In this case, the accused has a further strike against himself since he resisted arrest. Furthermore, being in a “free country” doesn’t mean we aren’t subject to established law enforcement procedures designed to enforce laws. Bottom line, if a police officer accuses you of a crime then challenge him in court. Don’t resist arrest, throw a public tantrum and then accuse the city of antisemitism, brutality, etc. As for you, Milhouse, I suggest you learn how the American legal system operates before posting on these stories as some self-proclaimed expert on matters beyond your scope. Funny thing is many people simply emotionally react to stories like this without clearly thinking things through. You, however, have calculated and conceived a response that demonstrates mental clarity, which is doubly disturbing considering the force with which you project your own ignorance. I’d like to think you mean well but the evidence would suggest otherwise; it seems that every other story on this site is followed by a “Milhouse” comment designed to elicit a strong reaction, thereby providing a ripe platform through which you can admonish others and (though further perversion) feel better about yourself.       The word “comply” is a word from the dictionary of fascist countries. The police had his plate and could have issued a summons for driving violation if appropriate, but a citizen just walking doesn’t need to “comply” to police. The constitution protects our rights.

      Boston, you only have to submit to a legitimate arrest. A policeman who is attempting to falsely arrest you is just a common criminal, and under the common law you have the right to resist, even with force; you certainly have no obligation to cooperate with your own kidnapping. (Yes, I’m aware that the Indiana Supreme Court recently ruled otherwise, thus making Indiana a police state. That is a very disturbing ruling, that should not be encouraged to spread into other states.)

      Evading police is a very serious matter. This is not a peaceful lack of compliance, such as just sitting on the ground. Police at this point had to take him as a serious threat, even if he was just carrying donuts. Nothing the cops did surprised me. I know people who ended up much worse for running.

    We were davening in the music room and heard screaming, the guy was yelling at the police that he didnt do anything wrong… hwo i heard the story was that he made a right turn onto lefferts (which is not allowed from 9-10 but if he was black the police probably wouldnt have done anything) and he went inside to bring in donuts for his daughters birthday, he was going to bring in other stuff later. he came in and the police followed him and his daughters teacher quickly brought her in her classroom so she wouldnt see… some teachers came and the guy was yelling at the police and trying to push him away, he called for backup and he refused to go in the car so they sprayed him and threw him in the car. we were all so worried!!!!!! also all the girls were looking out the windows, we saw most of what happened it was crazy!

    *Under what authority does a policeman approach a traffic violator outside the car? If you see a traffic violation, you pull the man over with lights and sirens.

    *Under no circumstances does a policeman have the right to mace a father in the presence of children. That area of the building is occupied by the early head-start, as well as the homework and tutoring areas.

    *If the traffic violation was the “No turn off Brooklyn onto Lefferts” rule, that sign is down more than it’s up. it can also be blocked by buses and other large vehicles.

    I bet if it was not a Jew, the violation would have gone unnoticed. I am convinced after seeing how many Jews are being targeted for minor violations while non Jews unhesitatingly speed down streets at crazy paces (I was almost run over on Kingston by some crazy goy blasting his radio and going about 75 mph) that this is a case of bias and it needs to be stopped. I don’t care what the spokesman said, and I agree that the man acted foolishly, but this escalated too quickly.

    What does the car have to do with it?

    A few years ago(?), two bochurim got arrested for standing on the sidewalk in front of their apartment building – just because a cop told them to move or some other nonsense, and they did not immediately comply.

    Whether the guy was right or wrong, there must be a proportional response. My daughter told me that there were 5 police cars, and that the cops threatened one of the secretaries and verbally abused her.

    A hundred dollar ticket has now ballooned into jail time and court fees for the guy. In addition there should and probably will be a law suit against the police for traumatizing the children and school staff and endangering the welfare of the children in the school.

    Just because a reckless cop did not get sufficient sensitivity training about this community and because an overzealous precinct needs to raise funds at the expense of the community’s good will.

    He probably could have just slapped the ticket on the car for the same result. But, of course, he had to rush head-on, guns blazing, into a school because of his ego.

    I thought that this new captain would bring even better relations between the police and the community. Especially since everyone knows that CH is a delicate community. Sadly it appears that this is not the case.

If he broke a driving infraction, at best, the police can leave a summons on his car window. At the time of incident, he was a pedestrian and a police officer can not detain someone who isn’t an imminent danger without an arrest warrant. You are a real jerk and putz.

    #1 This is not Boston, it is CH, a predominantly Jewish and Black community that has a history of police negligence and abuse. Add to that, the police dept’s knee-jerk reaction to racially-profile Chassidim and ticket them at every opportunity, whether warranted or not.

    Everyone here knows what he should have done – shut up and just take the ticket, right or wrong.

    But not everyone has a clear head when confronted by a police officer. Also not everyone can cough up a hundred dollars for some ticket, or take time off from work to fight a ticket when we all know, the ticket may be bogus, and the deck is stacked in favor of the cop.

    The issue is precisely what you emphasized: how the police ENFORCE the law. You assume every cop is a paragon of virtue. But a lot of the members of this community have witnessed first-hand, abuse whether verbal, physical or monetary.

    I’m sorry, you may be an “officer of the court”, but we here are “officers of Am Yisroel”. Our duty is to ENFORCE Ahavas Yisroel and to be melamed zechus on fellow Jews, not apologize for the police!

    Aside from the fact that this is an unspeakable tragedy in the life of a good human being.. If there is any way to justify these actions from any part of the story and NOT implicate the police for a crime, then there’s something big here that I missed. My friends, this is just the beginning. And not even the beginning, we’ve already seen the signs haven’t we? This also turns out to be a publicity stunt as well, showing that the Crown Heights police ALSO don’t like the Jews.     CH is the only Jewish community in NY that I’m aware of that recieves such tremendously low respect and grace from the cops.
    It is terrible to see how time and again- by and large the community is utterly disrespected and it’s peaceful law abiding citizens are completely abused.
    CH is also the only Jewish community in NY that I am aware of that has alternate side parking almost every single day of the week and the only purpose is kt generate ticket revenue.
    Go to BP, willy, five-towns etc they have parking restrictions ONCE a week.
    The reason for the above is only due to the extreme incompetence of the community council. A bunch of worthless nincompoops.
    This would not happen anywhere else. Neither would the other things we read about on this website.

    I’m not going to say the cop handled the situation perfectly. But frum people think they own the road. Illegal double parking and u-turns. Not using turn signals and pulling away from the curb without looking. If more people were ticketed maybe they would stop this bad behavior.

    This “innocent” father came running into Bais Rivka, tried to hold the door closed so the cop chasing him could not get in, he almost knocked over a group of mothers with their small kids & babies. He then ran up the stairs by the davening room and towards the Early Headstart room when he was stopped by the cop.
    He had no care or thought in his mind other than to resist arrest. He didn’t care that small children were witnessing this frightening scene..
    No, the cop should not have maced him or kept spraying him with mace. (I was there and ran out as soon as the cop started spraying. I was standing a few feet away and my eyes were burning the entire day from the 2 second exposure of the mace in the air…)
    No one could get this guy to calm down. He kept fighting to get away from the cop…
    What did he think was going to happen? That the cop would just give up and leave him alone? ?

    The sign for no turning is hanging high up and is not blocked.. the cops do wait there and they stop anyone that makes that turn before 10am.
    The turn is illegal so our little maidelach crossing will be safe and not get hit by careless drivers rushing to turn before the light changes

    If the motorist was only getting a parking ticket he isnt required to show any ID. If the Officer was trying to issue a moving violation, then an ID must be presented. Either way, a hugh lawsuit will be brought against the NYPD, and the city would be dumb not to settle. Just like the 84 year old Chinese guy who was jaywalking and got his beatdown.

    He should have known better and just showed his license. We all know that if you do not comply with police ruled this can happen. As much as its unfair this is the way things work here. He first did not want to show his license then didn’t want to be handcuffed. Off course it does not make sense but any NYPD cop would do that since he is no complied with rules.They have regulations they must follow. If he would have been stopped while driving and left his car the same would have happened.

And maybe 5 or 10 bystanders, like they did with that shooter at the Empire State Bldg (he only shot his one target; all the other people were shot by the police)? Tell us, what was called for, that the police went beyond?

    I’m so confused by your comments. You obviously didn’t read the article. The cop saw him commit a traffic violation. It doesn’t matter whether he is in the car anymore or not.

    Basically what your saying is that since he was no longer in the car he doesn’t have to show ID. So I’m going to go ahead and run every light in the city. I’m going to make sure many cops see me doing this. Park. Get out of my car….And when the cops ask me for my license I’m going to say Millhouse told me since I’m not in my car I don’t need to show you anything.

      No, the cop claimed to have seen him commit a violation. The man denied it. He knows whether he did it or not, and therefore whether the demand for ID is legitimate or not.

    He was driving a car. Why then shouldn’t he have to show his license??

    i was in middle of davening in the music room and i heard shouting of dont arrest me i looked out the door window and saw a police then i beacme so scared it was a frighteing and sad scene

    My objective is not to bash either party, I see no benefits from such labor.

    The goal of an officer is to ensure the peace and safety of citizens. This is accomplished by enforcing the laws set up by the state legislature.
    The laws consist of major safety concerns, like getting murderers off the streets, and also minor safety issues such as, traffic violations. Indeed, such violations are annoying, and it may seem that there is no social benefit, but lets put things into perspective.
    There has been over 30,000 deaths in America because of vehicles! And traffic violations has been the lead contributor to vehicle accidents. (Second, driving while intoxicated.)
    The police officer was doing his job, and protecting all of us from this potentially dangerous driver by reprimanding him. Although he arrested the individual in a brutal manner, he did not want to arrest him in that way. What was his other sensible alternatives?
    If you conclude that the officer should not have pursued the guy, then you are setting up a really bad precedent. Any person that commits a crime will just run away. Traffic violations will then become “optional”, and the amount of vehicular homicides will certainly increase. Unfortunately it occurred in-front of children, but the officer had no other recourse. I am quite sure that the officer would never want to encounter this type of situation. It was put on him, and he did not incite it, so stop making him into the aggressor.

      The goal of most policemen is not “to ensure the peace and safety of citizens”, it’s to assert their authority and keep citizens in their place, while earning fat salaries and moaning about how dangerous their job is (there are many more dangerous jobs).

      What were his other sensible alternatives? He could have let it go. If he really did witness a traffic violation (which we have only his word for) then he could write a ticket and put it on the car. Or he could look up the car’s registration and contact the owner to find out who was driving it, and then send him a summons or go to his home. There are many things he could have done if he hadn’t been hell-bent on making this person submit to his authority.

    If a officer asks you for your lic and reg and you run away, you are asking for trouble. If you start resisting a officer, you are asking for trouble.

    Time for a complaint against the nypd. To much power and to much force, what about the children in this school? They could have been injured by the pepper spray/mace. Or traumatized by the scene maybe parents or the school teachers,administrators etc, should sue the nypd.

    Wasn’t there, so can’t comment on the accuracy of the various descriptions of the entire occurrence. However, it seems to me that both the law officer and the parent involved have decidedly low E.Q.s (emotional quotient.) Both of them need help learning how to act/react to upsetting situations, regardless of whether or not they are justified in their anger. For the most part, this kind of behavior isn’t limited to one isolated incident…
