The grieving parents of a Brooklyn girl killed by a runaway bus have notified the city they intend to file a multimillion-dollar wrongful death lawsuit, the Daily News has learned.

In a notice of claim filed late last week, Amber Sadiq’s parents said they will also seek damages for their son Umar, 10, who watched as his 8-year-old sister was crushed to death on May 22 by a school bus sent down a hill by a little boy.

The legal papers charge the city with negligence for failing to secure the school bus, hiring incompetent workers and failing to supervise the troubled 8-year-old boy who sneaked into the vehicle and set it in motion in front of Public School 161 in Crown Heights.

“This has nothing to do with the money,” said Amber’s father, Imran Sadiq. “They have to change something.”

City officials are investigating whether PS 161 Principal Deborah Barrett and school employees broke rules when the boy was sent home on the day of the accident.

The boy’s father, Albert James, told The News that school officials repeatedly ordered him to take his mischievous son home. Home suspensions are illegal.

A spokesman for the Education Department said he could not discuss “pending litigation.”

James said he tried fruitlessly for 18 months to get city Administration for Children’s Services day care vouchers for the boy.

The vouchers arrived the day of the accident.

Andrew Finkelstein, the lawyer for Amber’s family, did not specify how much money he will seek in Brooklyn Supreme Court.

  • sue, money, sue

โ€œThis has nothing to do with the money,โ€ said Amber’s father

    Yeah right…
I think it’s high time that America makes it illegal to sue for exorbant sums of money for anything under the sun.

The school that suspended the boy might be dealt with, but even then what is a school to do with a constantly violent kid. He needs a special school, at least for a while.

They call the bus driver negligent. What does Amber’s family expect: Is the bus driver responsible to guard his bus 24/7? That’s ridiculous.

This is a very horrible thing that happened, but they can’t go blame the whole world and expect millions of dollars too.

Where do you think the money comes from when the city is sued? It comes out of our taxpaying and ticketpaying pockets!!!

  • loaded with tax payer-s cash

    though i agree,
It would nice for them to have some money to help out the costs etc.

  • We Suem & How

Hit them in the pocket. Then they may put locks on the buses. It is very forseeable that a chiald may clime into a school bus that is parked on a hill.
By the way, someone should tell the Daily News that you are not allowed to put the amount in the complaint anymore. In any case how much you "ask" for in the beginning, does not matter.

The blame for all these outrageous lawsuits should be on the lawyers who look for grieving people and then rile them up to make lawsuits, all to fill thier own pockets

    the parents should definitely sue!!!!!

it wont bring their 8 yr old daughter back to life but it maybe compensate a little bit 4 their open wounds!!

imagine if it was ch’v a little jewish girl who was killed?? then you would be saying to sue!! its absolutely insane!!!!

of course it shows negligence on the busdriver –

where was he at the time?
    why was the bus open?
how was tha 8 yr old able to manouver the bus?
    where were the keys?

    the principal too –

how can you send an 8 yr old himself without supervision?? especially considering the fact that hes known to be a mischevious kid?

people are able to sue for so many stupid other things – let them get money for this!!

  • Dont Sue

Parents of kids are responsible, and if their wandering the streets, they should stop that. if the girls parents want to sue, they should sue the boys parents.

  • sue

In all fairness, if Chas V’sholom you were in this situation, wouldn’t you sue? If you are really honest with yourself, the answer is probably yes.

  • the other side

Stop and think if that was your daughter. Money will help them to move away from a place that constantly remind of their child.

how can anyone pass judgement??, when a families life is completely turned upside down the ramifications are HUGE, from nervous disorders, sleeping habits to personal breakdowns where the main family breadwinner maybe cant perform as expected, G-D forbid anyone should be in this position, but let me say, when something so disaterous has happened parnosah can become an issue, and if this is the glue that holds a family together, go for it. It may not be about money as such, but is sure can help

I guess you have not read up on the story from the beginning.

    You write:
‘of course it shows negligence on the busdriver’
‘where was he at the time?’
He was eating, does he need your permission?

    ‘why was the bus open?’
The bus was not open, the boy broke open an emergency exit that is illegal to lock

‘how was tha 8 yr old able to manouver the bus?’
He released the emergency break and the bus began to ROLL DOWN Nostrand Avenue (The street is on a hill)

    ‘where were the keys?’
The boy did not use keys, he turned off the emergency break

And just as an added bonus, if the family claims that the bus driver not being with his bus at all times is negligent, then one would have to argue that the parents not being with their children when they go to school and come home from school is negligent…

No one is saying that nothing should be done, but why should the city be sued millions of dollars? If you are indeeed living internationally, it won’t be your tax dollars that will be used, but it will be ours. In all honesty, I really don’t think that my hard earned money needs to go to any family suing the city for millions of dollars for something that is largely not their fault.

While troubled street youth need serious help, don’t be too kind about the matter. Many of these young, mischivious children will grow up to be the muggers and felons of tomorrow.

On a final note, I think that parents need to take on more accountability on themselves and not blame the school for everything that goes wrong. The father of the young boy who pulled the emergency brake needs to remember that schools do not replace parents, and that parents need to actively enforce proper values and discipline at home. (This whole story is a vicious cycle because it was made known that this young boy’s mother left him and the father is said to be raising him by himself and an elderly grandmother…and during the day he works to bring in money)

My heart goes out to both families. we need to remember though that there are thousands of people in this country suing for millions of dollars.

OLne of the reasons that insurance costs are so high is because people sue left and right in the US for exorbant sums. Whatever the case, it is the average citizen that ends up paying for these victorious cases. Don’t be naive…
