Jewish Man Assaulted by Construction Worker
A Jewish man was punched in the face by an irate construction worker, who after asking to allow him to pull out of his driveway went berserk.
The incident occurred at around 9:00am on Brooklyn Avenue near Empire Boulevard. A construction crew from JEK Communications, who were subcontracted by Cable vision to run new wiring on the block, had some of their equipment blocking a driveway.
The homeowner walked over to one of the workers and asked if they can be moved so that he can pull his car out and drive his children to school, the worker responded by shouting at him. An altercation ensued and escalated when the worker punched the man in the face, smashing his glasses and causing sever swelling and bleeding around his eye.
Hatzalah and Shomrim were called and the man was given medical treatment, while the worker remained at the scene. Once police arrived the worker, a Hispanic male, was arrested and charged with assault.
While waiting for the police the assailant attempted to strike another man, who deflected the punch and was not hurt. “He was just so angry” he told CrownHeights.info
The victim was taken by Hatzalah to Methodist Hospital where he received further treatment.

Is JEK responsible for every crime its employees commit? So if a business owner has an employee that commits murder during his hours of employment, the owner can be sued for millions?

Probably not in the case of murder, but since this fight arose out of how he parked his employer’s truck, and parking that truck is part of his job, there probably is enough in it to invoke the master-servant rule.

That is correct. Anyway, he should sue Cablevision, they sub-contracted JEK, a small “tiny” company, that most probably have no money. Furthermore, IF this guy is here in the US illegally, AND working illegally, then oh boy…

It doesn’t matter how they tell him to park. Even if they do tell him to park illegally, they’ll never admit it, but it’s irrelevant. Even if they could prove that they explicitly told him not to park illegally, parking is still part of his job, so if he does it illegally they are responsible under the master-servant doctrine. The only way they get off is if parking was not part of this person’s duties, and he decided to do it anyway.

To the comment headlined “To #10”: No, he cannot sue Cablevision. Cablevision has no liability for its contractors’ actions. There is no master-servant relationship between them.

No, there is no possible claim against Cablevision. They are not responsible for what JEK does.

That opinion is irrelevant here, since the fight arose over the way the servant parked the master’s truck, which was a regular part of his duties. That should be close enough to invoke the master-servant rule.

He was charged with battery, not assault. Battery is the act of physically touching another person, assault is only saying it/threatening it.

First of all he’s not Hispanic, he’s Filipino. Second of all the Jew came outside screaming and acting irate. Third of all, he got what he deserved. By the way, the case was dismissed because the JEW put his hands on on the “PERP” first and multiple people witnessed it.
