BROOKLYN — A Brooklyn woman has filed a lawsuit against General Mills, accusing the food giant of making misleading health claims about the popular kid snack Fruit Roll-Ups.

In the class action filed Tuesday in Manhattan Federal Court, Payton McClure says the company lies when it says the rollups, along with Fruit by the Foot and Fruit Gushers, are naturally flavored, low fat, and “a good source of Vitamin C.”

BROOKLYN — A Brooklyn woman has filed a lawsuit against General Mills, accusing the food giant of making misleading health claims about the popular kid snack Fruit Roll-Ups.

In the class action filed Tuesday in Manhattan Federal Court, Payton McClure says the company lies when it says the rollups, along with Fruit by the Foot and Fruit Gushers, are naturally flavored, low fat, and “a good source of Vitamin C.”

“Unfortunately for consumers and, including children, all these claims are false and misleading,” the $5 million suit says.

Court papers say General Mills failed to note on packaging that it uses partially hydrogenated oil in the snacks, which the lawsuit says is “dangerous” and “unhealthy.”

McClure could not be reached for comment and the law firm representing her did not return calls.

A spokeswoman for General Mills said the company has not yet been served the lawsuit and declined comment.

    Give me a break. This woman is nothing more than a glorified gold digger, looking to make a quick buck. Everyone knows that fruit roll ups and similar snacks are nothing more than CANDY.

    I hope she loses, and start buying real fruit for her kids if she is that concerned.

    Curious: When a person files a suit like this, who gets the money? Obviously if she can file it and get the full $5m, then when I see she is successful, I can file too, no?

    nobody forced her to buy the TREATS for her kids and if she didnt buy them for her kids she is a gold digger and if she does buy them for her kids…read the label

    Those cereals are totally junk, not one drop with true nutritional value, but she does sound like a gold digger.

    I hope she loses. And whoever agrees with her is a pure loser. This lady definitely has issues. Why did she just wake up to the fact that fruit roll ups are unhealthy? They’ve been around for years. That’s the candy that I grew up with (not that I would give it to my kids because of the dentist issues!).

    I’m sorry, but thats a pretty lame lawsuit! If your bored find a job, you’ll make money, not $5 million like you were hoping for with this but something!
