Sholom Mordechai Rubashkin has lost two appeals for his request to be released on bail while he awaits sentencing.



The 8th Circuit Court of Appeals on Wednesday declined to hear a petition from Sholom Rubashkin. The court also declined to have a rehearing from a smaller panel of three judges on the same matter.

In January, the three-judge panel denied Rubashkin’s appeal to be released on bail.

The 51-year-old Postville man was convicted of 86 counts of financial fraud in November.

The Agriprocessors meatpacking plant in Postville was the site of a massive immigration raid in May 2008. Hundreds of illegal immigrants were arrested and convicted.

    Just for the record all his time now before his sentencing will count as time served and reduce his actual sentence which could be worth something if the sentencing judge shows some compassion.

    Ribbono Shel Olam, This is going from bad to worse, It was a nightmare to begin with. They are treating Sholom Mordechai as if he was a serial killer. Delegations of rabbonim, lawyers, askanim all went to plead his case and …. nothing. We have to daven with all hearts for another Adar miracle. I can’t bear reading the torturous treatment he’s getting. How can his family stand on their feet? The emunah and bitachon displayed by SMR himself and his family boggles the mind. In that zechus alone, his geulah should come instantly.

    I think that there needs to be a national outcry to this injustice. It has to go beyond the courts. Linda Reade sat on the committee that planned the raid. How in the world can sje also serve as justice in the case?

    The federal justice system was designed to treat all equally.
    That is why the feds were sent into the south to administer justice in the civil rights cases in the 60’s.

    The federal courts are blind to discrimination. If the Lubavitch community wanted him to be acquitted or to be treated differently he should have committed his illegal acts in CH and tried in a NY State court where the judges and juries ARE more inclined to be partial to the orthodox way of doing business.

    Your headline is wrong. He didn’t lose his appeal; the court didn’t agree to hear it in the first place. There’s a big difference; they didn’t consider his arguments and reject them; they never heard his arguments at all. Appeals courts have limited time, and there was little chance that it would consider it worth spending some of that time on such an appeal, which only concerns the few weeks or months until sentencing. The Appeals court simply said “you’ve already had one hearing, we assume that court probably got it right, and if they didn’t then it’s not such a big deal anyway”. Maybe if they’d actually heard his arguments they’d have decided to grant bail. For instance, they certainly had no idea of the conditions he’s being held in, or that he’s been sent to solitary confinement for no valid reason.

    Mordechai and Moishie you are both right but don’t think anyone will listen to a word of sanity in this case. And the irrational crys of anti-semitism is backfiring and causing real damage to us, instead of us being the guiding light to the nations WE are sadly causing those that previously were our strong defenders to raise an eyebrow……not good.

    #1 Sholom Rubashkin was a EISH HACHESSED and may Hashem help him with everything including open miracles.

    Although the publicity is needed to raise funds etc. I think it is working against the case because one reason for sentencing is that no one should follow suit in the crime. A judge may not want to give the message that with enough funds and support you can annul any decision by the court.

    to moishe and mordechai: you don’t get real information from reading the news. they are usually biased & exaggerated to make it sensational. plus, you always have to hear both sides and not just what the news says. besides, your first reaction should be “dan l’kaf zchus” and not judge and jump down another yid in his tsoros. that is why the beit hamikdash was destroyed and will only be rebuilt if we rectify it through unconditional ahavas yisroel, not through jealousy and hatred.
