INBOX: F-1 (Student) Visas For Non-US Citizens Coming to Study In the United States

I want to share a PSA for all non-US citizens who are coming to New York for studies:

I studied in New York on an F-1 (student) visa for two years. When I enrolled, I specifically asked about Optional Practical Training (OPT). This visa allows one to stay for a year after their studies and work in their field of study. I previously used OPT after a seminary program and wanted to confirm whether I’d be eligible again.

I was told yes by my DSO (designated school official), multiple times. At enrollment and throughout the program, I was told I could get OPT again because this was a different school.

That information was incorrect.

OPT eligibility is based on the level of education, not the school. You can have more than one OPT, but only if each one is for a higher level (for example, bachelor’s after associate’s, or master’s after bachelor’s). Doing another program at the same level does not make you eligible for a new OPT.

I only found this out after I applied for OPT and spent a few months waiting for a response. During that time, I could have applied for a different visa type.

I’m sharing this to prevent others from relying on inaccurate information when making visa decisions. If you’re planning to study in the U.S. on an F-1 visa and expect to use OPT, verify the rules yourself. DSOs aren’t always familiar with all the laws. If you’re unclear, check with an immigration specialist.

Hatzlacha Rabba!
