Restraining Order Stayed in Appeal, Elections Back On

CROWN HEIGHTS, Brooklyn [CHI] — Arguments before the State Appellate Court was heard a short while ago and judge Daniel Angiolillo granted a stay of the Temporary Restraining Order which barred the elections from taking, clearing the way for the elections to still take place.

Contrary to rumors which have been spreading, the victory in court today only reflected on the TRO that was granted yesterday, which was the only item that was contested. The case is still set to be heard on June 3rd in which the merits of the case will be argued.

Arguments by Elie Poltorak and Edward Rudofsky were heard in court late this afternoon.

A source close the case told CrownHeights.info that the TRO was not ‘vacated’, meaning that it is still on the table as is the entire suit which was brought by the currently sitting Vaad and body of Netzigim led by Yanky Suffrin, who claim to be the legitimate Netzigim.

The case that is being argued is on the merits of the entire elections and the bylaws which support it. The source called the whole elections a fraud, which violated the Pask Din which was issued by Rabbis Osdoba and Segal, which itself is a violation of the bylaws. According to the source the bylaws of the Vaad Hakohol state that any Psak Din by the Beis Din must be adhered to.

While a source from the candidates said told us that the lawsuit was to enforce the Beis Din Psak, which was that there shouldn’t be elections, but once there are elections it becomes moot because the elections already took place. Adding that they are confident that they will be taking office once the elections take place.

  • Osodba-s Team looses BIG TIME

    I predict that Osdoba’s team will quit the case before the 3d of June, because everyone knows the truth, that “they are FULL OF IT” and they don’t want real justice.
    It was all just a TRICK to wait untill the last second and try and sneak and underhanded TRO from a gullible Judge.

    The people now in charge of the CHJCC, who are full of corruption, are not the least bit interested in any real trial.

    They only want “delay tactics” like a fake TRO to undermine justice but are not the least bit interested in any REAL DAY IN COURT.

    When they “day in court” comes around, Osdoba’s supporters will run for their lives and QUIT the case, in fear that justice will get them in to the same place where Justice got Moshe Rubashkin, now.

    If they were really interested in any real justice, why did they deliberately wait for the LAST SECOND (elections were announced 3 months ago) to try trick the judge with an underhanded “last second” FAKE TRO attempt?

    Thankfully the Appellate court is not as gullible as the maid who issued the TRO in the first place.

    In my humble opinion…

    Rabbi Osdobo should put out a letter before shabbos that everyone must go vote, and if you oppose the elections, take the ballot and write NO!
    Then, if they see that everyone is opposing the elections, they will see the truth!

    That’s fair!

    (and this way, Rabbi Osdobo won’t have to hide his face after the ecletions)

    Its amazing how every claim you have is being turned around backwards. Hiow ironic is it to see, that the party that opposes elections and wants to stay in power indefinitely, refers to the other side as corruption and lipa!     The Only way to resolve this is to go to a third party beis din which both rabonim agree to go to which is the beis yosef beis din of boro park both rabbi osdoba and rabbi shvey agree to go and submit to the final psak from that beis din so in essence there is no need for any elections untill that psak comes out and then all the rabinom will agree to the elections in unity there is no need at all for court
