Newlywed Sentenced to Month in Jail

An Israeli military court in Jaffa has extended the incarceration of Devorah Leah C., a Lubavitcher newlywed who was detained while trying to verify her draft exemptions en route to Crown Heights for Tishrei, by 24 days.

The ruling was handed down at 8:30pm, Thursday.

The judge, Lieutenant Aharon Pinchas, ruled that the penal code of the military requires certain conditions for the incarceration of draft dodgers, and she therefore cannot be released to house arrest under any circumstances.

Askanim who are working on the case have vowed to appeal the sentence.

Mrs. C. is exempt from military service because she is religious and because she is married. Her oversight in filling out the required form in a timely manner is what led to her arrest and incarceration.

  • I feel sorry but...

I really feel bad for this women. However, this could have been avoided easily! Every frum Israeli girl gets a release very easily. As I did when I turned 18. I actually live in America when I turned 18. So the summer before my 18th b-day I got a release in 2 seconds by bringing a letter from an israeli bais din. She failed to do that when she turned 18. Now that she wanted to leave the country she was “caught”. In any case i wish her luck

It sounds so unfair and harsh, but the IDF can’t be lax in its judicial system if it is to maintain its integrity.
The Israeli army provides expemtions and they need to be accompanied by correctly filled forms.

haha dovid you are hilarious and make no sense. I do no think this girl thought she was above the law. if the woman stopped at a police station to make sure her papers were in order then she clearly did not do anything against the law knowingly. If she knew she had done something wrong she would have tried to avoid being caught leaving the country.

Crown heights for tishrei.???!.. border control here would have done the same anyway…

  • To Number 4 - IDF

I don’t know who other than yourself made you an IDF spokesperson, but you sound like the real thing because you speak bureaucratic dribble. This is a highly political case. It is not a punishment for a crime and has nothing to do with not being lax.

  • To # 6

It does have to do with being lax. I read on hebrew COL that she failed to take care of it when she was supposed to. If it was political, then why are they only doing it to her?

  • Tamar

I wish IDF would work so meticuolosly in the arabs cases….
Eretz Isroel would have much more fresh air.

  • Ridiculous

Ridiculous!!! Imagine if you went to renew your license and it was already expired and instead of paying a small fine you get sent to jail.
That is what this is compared to. No charedi israeli woman serves.

  • GadolHador

Hopefully this will send a message to those who wish to avoid military service (something that they should be ashamed of).

  • In the know

If you don’t know the details, please spare the comments. This is more complicated than it seems at first, and the IDF has a case. The way of dealing with it is harsh and evil, it could have been settled by a very simple act. They chose to battle her, and came out looking very bad.

If it was so easy to do why didn’t she take care of it when she was supposed to? Was there some kind of misunderstanding?

  • Dudester from Pittsburgh

Number 4: Mr. IDF: Go check out your Jewish neshama. Who the hell gets 24 days of jail time for not filling out proper papers? Is this the Bolshevik Prison Term stepping in? Or is it the democratic free state of AM YISRAEL. 24 days in prison is for petty fraud, child harrassment, stealing, I don’t know. But draft dodging for a religious married woman?

  • Married a long time ago

So instead of a life sentence in a marriage she got 24 days in jail?
Hmmmmm…. What is the better choice?? : )

  • Milhouse

#3, WHAT service? She’s religious, so she’s exempt. Why should she be punished just for forgetting to file a form? What kind of rosho would do that?

#4, What integrity is there in putting someone in prison for forgetting to fill in a form?

#6, What are you talking about?

#12, You are a shoteh, rosho, vegas ruach. How many times do you need to be told that RELIGIOUS WOMEN ARE EXEMPT? How many times do you need to be reminded that all the gedolei hatorah agreed in the ’50s that giyus noshim is completely forbidden by the Torah? But of course you don’t care about the Torah at all, so you have no interest in what it says. Sheigets arois!

  • This is a good way to discourage Aliyah

Why should someone want to make Aliyah to a country that does these things to a frum married woman

  • The IDF should of given her a heavy fine

that would of raised money for the IDF

What does the IDF get if a frum woman has to sit in jail for 24 days

  • From the heart

Milhouse is right. She’s religious, not some secular who must risk her life defending Israel.

  • Get the facts straight!

You write “Her oversight in filling out the required form in a timely manner is what led to her arrest and incarceration.” This is simply not true. At one point she was less observant and decided to join the army. Not only did she not “fill out the required form,” but she actively came to the bakum (where everyone gets drafted) in order to join the army. She changed her mind at the last minute, but at the point a) it was not up to her and b) she should’ve dealt with it instead of disappearing and hoping it would all go away! A draft dodger is a draft dodger, and there is no reason she should not face the consequences. After serving time for avoiding the draft, she can get out of military service – but those are two separate issues.

I’m sick of hearing people say “she forgot to fill out a form.” Not only is that not true, this is the army! Would the IRS be so understanding if you “forgot to fill out a form” and never filed a tax return? Ha!

She obviously knows she did something wrong. If she would’ve just left, border policy would’ve arrested her on the spot. She was listed as AWOL b/c she never showed up for her draft date, which incidentally, she signed up for. The CH news sources are hiding the fact that she was not always so religious and chose to join the army rather than state she is religious. When she got cold feet, she thought it would all just go away. Obviously not.

I know of a case where the person really was not at fault, and tried to take care of everything – and served in the army – but still got 30 days of prison for not showing up on his draft date. Everyone living in Israel knows the rules. They are very easy to follow.

#21, If you support the conscription of women, then GET OFF THIS SITE. The halacha is clear, and nobody is entitled to argue against it. ALL the gedolei hatorah ruled in the ’50s that giyus noshim is ossur; and that is the end of the story. There is no room for disagreement.

  • michal

Why would a religious person want to join the IDF since it is run by the Erev RAv who put soldiers in harm’s way, tear down beautiful Toradik communities, and ties their hands when trying to fight Israel’s enemies. Also, they make it very difficult to be observant even in Nachal Charedi. Being frum is more protective for Israel than putting on a uniform for the ER.

  • Hashem Hu Malkeinu

So, even if it is true that she once wanted to join the army when she was a rebellious teenager, we have a newlywed Jewish woman sitting in jail for a nonviolent administrative offense during Tishrei in a Jewish state. What’s more, she tried to do things the right way, but the Bolshevik state, the Israel Soviet Socialist Republic (ISSR) just wants to show its might. Of course, it dare not show its might when it comes to releasing thousands of murderers for all kinds of empty promises.

Worse yet, we have Jews defending the rogue Jewish state’s behavior on a Chabad site.
