The city cannot be held financially responsible for a traffic cop who waved a bus through a red light and into a pedestrian, an appeals court ruled yesterday.

Stella Lewis suffered “catastrophic injuries” when the crosstown bus smashed into her in Herald Square, including a brain injury and the loss of three toes, said her lawyer, Gail Kelner.

“This was a very busy, athletic woman who enjoyed life,” Kelner said. “Her life has been ruined.”

Lewis, now 59, was walking to Penn Station and had the light in her favor as she crossed West 34th Street on the evening of Feb. 7, 2006, court papers say.

The bus knocked her to the ground, smashing her head into the pavement, and ran over her left foot, crushing part of it, Kelner said.

The New Jersey woman’s suit against NYC Transit and the bus driver can continue.
