Rubashkins Lawyers Head to Supreme Court, Sentencing Set for Pesach Sheini

Lawyers for Sholom M. Rubashkin last Friday asked the U.S. Supreme Court to review his conviction in the District Court of Northern Iowa, in hopes that the highest court in the country will find reason to revisit the case.

The lawyers filed a petition for a writ of certiorari, in which the Supreme Court agrees to review a lower court’s case.

Since the former executive of now-defunct Agriprocessors Inc. was found guilty of bank fraud and other charges in November, his lawyers have appealed to have the conviction overturned, or for their client to get a new trial altogether. Earlier in the week, the appellate court had denied Rubashkin’s requests. He also has been denied bail on several occasions.

Rubashkin’s Supreme Court tactic is a long shot: The Court grants only about 1 percent of the petitions it receives.

Meanwhile a sentencing date for the conviction in the first trial was set for April 28, which is Pesach Sheini, in U.S. District Court in Cedar Rapids.
