Full Stay on Student Mask Mandate Put In Place Until Appeal Completed

The relief from the requirement for students to wear masks in schools was short lived, and may remain unchanged for a while.
A full stay on the student mask mandate upheld by Governor Kathy Hochul has been put in place by New York State Supreme Court as the state fights to reverse a ruling against the mandate by a Long Island Supreme Court Judge.
“I commend the Appellate Division, Second Department for granting a full stay to keep our masking regulations in place for the duration of our appeal,” said Governor Hochul. “My primary responsibility as Governor is to keep New Yorkers safe. Mask regulations keep our schools and businesses safe and open, protect vulnerable New Yorkers, and are critical tools as we work to get through this winter surge. Thanks to our efforts, including mask regulations, cases are declining and we are seeing major progress in the fight against COVID-19. I thank the Attorney General and her team for their defense of these common sense measures, and I am confident we will continue to prevail. We are committed to doing everything in our power to keep New Yorkers safe.”
Less than one week ago, a New York State Supreme Court Judge overturned a State mask mandate for students, saying that the governor overstepped the bounds of their office in enacting the mandate.
The State filed an appeal, and a stay on the overruled mandate was upheld by the Appellate Court.
