Tannersville, PA — The third and final suspect sought in the brazen shooting of two NYPD officers that left one officer gravely injured and his partner wounded early Monday morning was captured along a remote section of a Pennsylvania roadway early this morning.
Pennsylvania State Police, U.S. marshals and NYPD detectives worked together to capture 34-year-old Robert Ellis early this morning in Tannersville, Pennsylvania, following an all-night manhunt for the third and final suspect sought in Monday’s shooting.
At an afternoon press conference, Police Commissioner Ray Kelly said investigators had received critical information about the whereabouts of Ellis and 34-year-old Dexter Bostic, who was captured just before 6 p.m. yesterday, from an unidentified man who drove them on a journey through four states over the past four days.
Kelly commended the teamwork involved in taking down the suspected shooters.
“Ellis was found just a few hundred feet from where Bostic was found yesterday. There was very heavy brush; I think a New York City police dog, a bloodhound, was actually on the trail and flushed him out. He was sighted running by a U.S. marshall, who was there with our HIDTA task force,” said Kelly. “So, all in all, an excellent team effort and as I say we’re very appreciative of all the support that we received from law enforcement authorities in Pennsylvania.”
Kelly said that NYPD detectives has been in Pennsylvania since Tuesday night, working closely with members of the Pennsylvania State Police.
“It’s going to be a tremendous relief to everybody that was involved, and in addition to that I’m sure it’s going to be a tremendous relief to people back in New York City, most especially the families of the officers who were shot,” said Captain James Murtin of the Pennsylvania State Police.
Bostic cannot legally fight his extradition and is expected to be brought back to Brooklyn as early as today.
Kelly says the suspects fled Monday’s shooting in Crown Heights with the help of the unidentified man who drove them on a journey through four states.
From Queens, police believe the suspects fled using a circuitous route, first taking a ferry from Port Jefferson to Bridgeport, Connecticut, then stopping in Tarrytown, New York for food before heading down Route 80 through New Jersey and winding up in the Poconos.
Pennsylvania State Police received a 911 call alerting them to the position of the suspects along Route 80 in Mount Pocono Township, Pennsylvania.
”State troopers rushed to the area,“ said Kelly. ”Bostic and Ellis ran across the interstate to a wooded median where the pursuing troopers tackled a winded Bostic. Ellis is still being sought.“
Police believe Ellis and Bostic shot Officers Russel Timoshenko and Herman Yan after they were stopped by the officers while riding in a stolen BMW early Monday morning in Prospect Lefferts Gardens. Police say Bostic worked at the dealership where the SUV was stolen from.
Dozens of NYPD officers turned out at a Downtown Brooklyn courthouse Wednesday afternoon for the arraignment of the man prosecutors say was driving the SUV. Lee Woods, 29, who was arrested Tuesday, was formally charged with two counts of attempted murder in the second degree, two counts of aggravated assault of a police officer, and weapons possession. He was ordered held without bail.
His attorney says Woods has nothing to hide.
”The district attorney is accusing him not of pulling the trigger, not of shooting any of these police officers, but of being a part of whatever else may have been going on,” said Patrick Michael Megaro.
Prosecutors say that while Woods was driving the stolen SUV when it was pulled over after officers noticed the plates didn’t match the vehicle, he did not fire any shots.
All three men are from Queens and have extensive criminal records. Kelly says they may even have been involved in a shooting as recent as this past weekend in Nassau County.
Commissioner Kelly visited with Officer Timoshenko’s family this morning at Kings County Hospital. The 23-year-old remains hospitalized in very grave condition after being shot once in the face and once in the neck. Officials say he is now paralyzed and suffering brain swelling and cannot breathe on his own.
Kelly says the family knows that police and doctors are doing everything they can to save the officers life.
Officer Yan was released from the hospital Tuesday and is now recovering at home.

The people who live in those areas where there are people like that should get smart and call the police when there is a suspicion. Otherwise, it ends up in tragedy like with this good young policeman who is fighting for his life. There have been miracles, so lets hope that this policeman recovers.
When Guliani was here, we didnt have this open violent crime as much. Bloomerg is good for the city, but CHts isn’t doing as well under him.
Everyone has to do the best they can to try and report whatever they see going on, and we always need to support our private rescue patrols.
Glad these guys got caught, and I hope that they throw all the legal harshness on him that is possible.
