Legislation To Mandate COVID-19 Vaccines Introduced in NYS Assembly

Legislation to mandate COVID-19 vaccinations was introduced in the New York State Assembly this past Friday, and will be making it’s way through the bureaucratic process.

The legislation aims to modify the existing health law to mandate vaccines for all New York State residents if the state believes that it is “not developing sufficient immunity from COVID-19.”

The proposed law states that “Once the United States Food and Drug Administration’s Center for Biologics Evaluation and Research and the New York state clinical advisory task force have approved the safety and effectiveness of a COVID-19 vaccination and promotion and distribution plans of such vaccine have begun pursuant to the department’s COVID-19 vaccination administration program, if public health officials determine that residents of the state are not developing sufficient immunity from COVID-19, the department shall mandate vaccination for all individuals or groups of individuals who, as shown by clinical data, are proven to be safe to receive such vaccine.”

The law proposes a way out in the form of “a medical exemption from a licensed medical professional,” but does not specify if a previous case of COVID-19 would be sufficient for an exemption. New York State has also done away with religious exemptions, making such a mandating virtually binding to all.
