Protect Your License and Stay Out of Jail

As more motorists than ever take to the roads during the busy summer season, a Brooklyn company is attempting to prevent the number one cause of arrests within the frum community: driving with a suspended license.

According to Ari Elbogen, Vice President of Business Development for My Driver Alert, a staggering number of New York State drivers have no idea that they are driving with suspended licenses. While New York State does mail suspension notices to drivers, there is no guarantee the motorist ever receives them as they are often misplaced, forgotten, delivered to the wrong address or simply lost in the mail, resulting in countless motorists who are completely unaware that they are driving with a suspended license.

There are numerous reasons why a motorist’s license might be suspended including excessive moving violations, failure to pay tickets, fines or surcharges, child support, failure to file an accident report and failure to respond to a Department of Motor Vehicles notice. Additionally, not only can driving without insurance cause your license to be revoked but if another driver is pulled over while driving your uninsured vehicle your license can be revoked as well.

“These things happen all the time,” said Elbogen. “You lease a new car and the insurance company or the leasing company doesn’t notify your insurance carrier until the next day and in that twelve hour time period, you get pulled over and there you are driving an uninsured vehicle. You have a friend or some local business help take care of a ticket for you, but they don’t. That ticket is still on your record.”

A routine traffic stop can turn into a disaster of epic proportions for any motorist with a suspended license who will likely find themselves arrested and imprisoned, in some cases for up to 24 hours, a potential disaster for those who are traveling Erev Shabbos.

My Driver Alert was created to prevent drivers from being arrested because they were unaware that their license has been suspended. Their TikHit program, approved by the New York State Department of Motor Vehicles, gives motorists the ability to view their driving records and be alerted immediately via TEXT or email, if there is any change to the status of their license by enrolling at www.TikHit.com .

“We want to help people stay out of trouble,” said Elbogen who reports that of 500 license checks run in the past few months, more than half of which were problematic. “We want to spare you and your family the trauma, cost and embarrassment of being arrested.”

This is a secret New York plan to get cars off the road. The suspensions notices according to law have to be sent out certified mail. Another bureaucratic and legal headache curtsey of New York.

“The suspensions notices according to law have to be sent out certified mail.”

Uh, no. See Vehicle & Traffic Law, section 510(4-a)(a):
“Such suspension shall take effect no less than thirty days from the day upon which notice thereof is sent by the commissioner to the person whose driver’s license or privileges are to be suspended.”

No particular form of notice is necessary.
