3 NYPD Officers Surrender in Assault Case
BROOKLYN, NY [NEWS12] — The three New York City police officers accused of violating a Brooklyn man during an arrest surrendered Tuesday morning, authorities say.
Brooklyn District Attorney Charles Hynes announced a 32-count indictment against officers Richard Kern, Alex Cruz and Andrew Morales, police officers assigned to the 71st Precinct which is under the command of Inspector Peter Simonetti.
The officers are facing criminal charges for allegedly assaulting 24-year-old Michael Mineo with a retractable baton in mid-October inside the Prospect Park subway station.
Kern is facing the most serious charges, which include first-degree aggravated sexual assault. Cruz and Morales are also facing multiple felony charges, including hindering the prosecution and official misconduct.
Investigators say the three officers thought they saw Mineo smoking marijuana and ran after him into the station. At that point, investigators say Cruz and Morales held Mineo down while Kern violated him with his baton. The officers’ attorneys, however, insist their clients are innocent of any wrongdoing.
