Gaboim’s New Lawsuit Challenges Rebbe’s Directives

In 1990, the Rebbe instructed that the corporate documents for all three central Lubavitch institutions: Aguch, Merkos and Machne Yisroel be reviewed. The Rebbe also instructed that among some fundamental changes to be implemented, the membership of Aguch be limited to its 20 directors. Yet, as the Gabo’im file another lawsuit to delay their pending eviction from 770, they reject the Rebbe’s wishes by listing several members of Anash as members of Aguch. Further adding insult to injury, a few of these people are not even aware that they are plaintiffs to this lawsuit!

The Revised By-Laws state that “the Corporation shall have twenty (20) members.” In a document from March 1990 titled “Agudas Chasidei Chabad Unanimous Consent of the Members” – which the Rebbe affixed his holy signature to – it clearly states: “the undersigned being all of the Members of Agudas Chasidei Chabad.” By affixing his signature to the document, the Rebbe attested to the fact that the twenty individuals whose names and signatures appear on the document were the only members of Agudas Chassidei Chabad.

However, in a deplorable development, a new lawsuit has been filed by the Gabo’im in which a group of Anash is supposedly claiming that, as congregants of 770, they are “statutory members of Agudas Chasidei Chabad.”

This claim blatantly contradicts the 1990 document, and is a direct challenge to the Rebbe’s authority.

CrownHeights.info has contacted several of the participants in the lawsuit, only to find out that they were completely unaware of the fact that their actions were in opposition to the 1990 papers which the Rebbe himself approved and signed. In fact, a few claimed that they had no idea how their names had gotten attached to the lawsuit altogether.

CrownHeights.info then contacted the Gabo’im to hear their explanation for all this, but they were “unavailable for comment.”

Representatives of Merkos and Aguch said that they are not concerned with the new lawsuit as far as the legal challenge that it poses, but that the more concerning issue is the grave Chillul Hashem involved.

Many Crown Heights residents, when informed of the lawsuit, voiced their outrage that anyone would intervene on behalf of the Gabo’im, who have allowed an atmosphere of terror and violence to develop and fester under their control.

The past few weeks have only further demonstrated the need to accelerate the process of bringing 770 back under the control of those that the Rebbe entrusted, and not allow the craziness to continue even one extra day.

    not really commenting on the lawsuit in general. I’d just like to point out that (at least it seems to me) regardless of any lawsuit, the trustees of Agudas Chasidei Chabad of United States will have to change at some point since it’s been over 20 years since the Rebbe signed this document. not all the people on the document are living and everyone else is only getting older. what will happen to the corporation in another 20, 30 or 40 years when nobody on that list is living anymore?

    Paragraph two of the document the Rebbe signed states quite clearly: “The following twenty persons are hereby elected as Trustees of the Coperation, to hold office subject to the By-Laws until their successors shall have been duly elected and qualified.”

    ‘Successors’ speaks quite clearly to the event of someone passing away and leaving a vacant spot.

    Some of the people on this list don’t even daven in 770 on a regular basis.
    I must say I am shocked at some of the names on this list, I am sure at least a few of them were not aware that they are being roped into this case.

    The Gabboim have allowed the Tzfatim to run wild in 770, the place is an embarrassment. The people who signed onto this lawsuit are enabling the madness to continue.
    Some of the people on this list own business in CH, I will be boycotting their stores. Other people on this list work for CH intuitions; they should be fired as their actions are destroying Chabad Lubavitch.

    I heard that Rabbi Zalman Chanin, in the name of all Lubavitch Chassidim, went to secular court to sue Rabbi Krinsky PERSONALLY without permission from a beis din!

    If true, all this is out of hand.

  • Elections

    As much as I don’t approve of what is going on in 770, I still believe that the community has a right to have a say in the matter. I don’t believe that the Rebbe would abolish a fair election in which the community elected Gaboyim.
    I think that if Aguch wants to control 770 they should put up their Gaboyim for election. I would definitely vote for them.

    Why should CH residents be the ones to elect Gabboim? Isn’t 770 a central LUBAVITCH institution, and there for belongs to Anash around the world?
    Why should someone living in CH who only davens the whole year in Maple street or Beis Shmuel (or anyone of the 50+ congregations in CH) have more of a say than someone from London, who only davens in 770 when they come to town?
    And how does one define Anash? Is a clean shaven, ring wearing, short jacket wearing resident of CH more Anash than a full bearded, kapota wearing resident of Monsey?

    I am looking at the names that are on the 1990 papers. If as you say that these are the names that the Rebbe put on and signed his holy siganture on it, then why is Rabbi Sholom Mendel Simpson not on the Corporation any longer. If its as holy and edged in stone as you say it is then WHO HAD THE RIGHT to remove him – regardless of the reason – YOU DONT CHANGE WHAT THE REBBE DID!!!!- and the same goes on the Merkos Corp from 1990 Rabbi Simpson was removed. – The only answer is , that its ALL POLITICS, they put on whom they want tand take off whom they want. so maybe its NOT THAT holy. or maybe the people who ARE on the corporations are not THAT holy – cant be both ways my friends.

    Does anybody have any information (with names dates sources etc.) if the Rebbe ever overruled an election?
    I don’t remember the exact Loshon, but what I do remember is that after the Rabonim were elected the Rebbe said that an election in which the community elects a representative carries very strong weight.

    Without naming him, I recognize the name of a friend of mine who would never support Aguch. What is the point of this dreckishe lawsuit? They might as well add some askonim from BP and Williamsburgh while they’re at it. I’ve seen better Purim pranks.

    when aguch could not decide on a new rov, the rebbe split aguch/merkaz from the ch community, creating an elected beis din for the community, while aguch & merkaz remain above those rabbonim & are accountable to the us based vaad rabbonei lubavitch, putting 770 not in the hands of the community, but under the control of aguch/merkaz, who represent all lubavitcher chassidim

    the “elections” for gabboim were held after the elections for the rabbonim & the rebbe told the mazkirim that he will not come down to shul until those gabboim are off the bima!

    Aguch has no problem going to court and I don’t see crown heights.info complaining about that. Look at how much money was spent on trying to keep Scharf, Thaler etc out of 770
    and Aguch lost. You never write about that

    Meshichistim go to court, they loss and then they cry foul and demand a “Din Torah”. Where do they want a “din torah”, they demand that in take place in their own corrupt Crown Heights Beth Din, which by the way does not exists anymore and even at its prime was corrupt to the core.

    Meshichistim mossrim cry: “don’t treat use like we treat others, it’s not fair, waaaaaaaaaaaaaaaaaa”.

    The only reason the Meshichistim mossrim are still around is only because those “coming after you” are not coming hard enough. Had we (normal chabad) come after you people aggressively from the start (18 years ago) you would have crumbled.
