Tamir: “I have total confidence in R. Braun’s Integrity”

Zaki Tamir, chairman of the Vaad Hakohol, posted a lengthy post on his personal blog clarifying his personal stance on the matter of the Ikkul issued by the Krauss Beis Din, and declared his confidence in Rabbi Yosef Braun.

This letter by Tamir is apparently written in response to the firestorm which was set off by our Friday article exposing the dirty stunt pulled by Menchem Shagalow – a Braun supporter, an incident which Tamir refused to comment on.

The following is a statement posted by Tamir on his blog:

A few days after the ikul was issued, I was in communication with Rabbi Rosenberg, and we discussed a conversation he had with Rabbi Krauss (who issued the ikul).

In a conversation between Rabbi Rosenberg and Rabbi Krauss, Rabbi Rosenberg informed Rabbi Krauss that even before the ikul was issued:

1. The hachtarah had already taken place
2. Rabbi Braun’s contract had already been signed by the majority of the vaad members, and was apparently in full effect
3. That the shtar birurin of the zablo din torah had been signed on by all of the elected bodies of the kohol (the Vaad Hakohol, the Rabbonim, Gabboim, etc.)
4. The elections had taken place in a very public manner, under the guidance of the zablo, and that a large majority of the kohol had participated

These crucial details may have not been disclosed to Rabbi Krauss by the plaintiffs at the time the ikul was issued.

Furthermore, Rabbi Rosenberg challenged the ikul by questioning how any group dissatisfied with the psak din could have the right to run to another beis din to overturn that psak. If so, any group claiming to represent the Crown Heights community could always go to an outside beis din, and there would be no end to the conflict.

Rabbi Krauss conceded to Rabbi Rosenberg, stating that if the plaintiffs could not demonstrate that they could act in a way that would bind the entire community, then he would retract the ikul (Rabbi Rosenberg told me that he believes that the plaintiffs cannot demonstrate this).

It is very important to note that the ikul stated that a hearing date would be announced “within the coming days.” Since the ikul was issued, nearly six weeks ago, the Vaad Hakohol has received absolutely no communication from the Beis Din of Rabbi Krauss. We were never informed who the plaintiffs were, the reason the ikul was issued, or received any hazmonah. In fact, the ikul itself was not appropriately served to the Vaad Hakohol, but instead a copy was faxed to the Vaad Hakashrus office.

I have made numerous attempts to reach Rabbi Krauss. My calls have never been returned. I managed to reach him for a brief moment a few days ago. He told me to call him in the evening. Since then, he has not taken my calls. I hope that Rabbi Krauss will retract the ikul, in order that (as Rabbi Rosenberg said) there will not be “war” between batei din.

Until then, the Vaad Hakohol will continue to act as responsibly as we can to resolve this issue. It’s unfortunate that the lack of a functional Beis Din is what forces the Vaad Hakohol to have to bear the full burden of these decisions.

Finally, the Vaad Hakohol has spent much time, effort and money to ensure that the Din Torah and elections could take place correctly. The community came out in force to vote for Rabbi Braun, and we honor and respect that decision. I, personally, have total confidence in Rabbi Braun’s integrity, talent and his ability to fulfill his position of Rov in a manner that will honor the Rebbe’s schunah.

    What a needless firestorm of conroversy!…after attending Tomchei Tommimim Yeshiva, I had lived in Crown Heights for the previous 8 years and reflectively it was a daily effort to stand clear of the constant mishagos and machlokes generated by apparently “small minded” Chasidim. My anticipation was that the Yidden that I was hoping,(and praying), to be guided by, should demonstrate the living example for how a Baal T’chuvah was supposed to behave. Instead, what I observed, (thank G-d from a distance), was a petty and hypercritical display of invective and class distinction/warfare that was hard to reconcile given my expectations that Lubavitcher’s embodied the finest principles and mirrored the shining light example of the Rebbe as Nasi Ha’dor. So I eventually found my “people” so to speak, who were above the mud slinging and loshon hara, and I made my way carefully avoiding the troublemakers. Now, I live in Sydney Australia and have a blessed life with family and loving new friends. I have since gotten to know Rav Braun and have found him to be a brilliant scholar with a kind heart and boundless wisdom, who has only the desire to serve, and to fulfill the Rebbe’s will. The community of Crown Heights is blessed to have such a man, and this senseless hatred and blind rush to judgement is detestable at best. Each one of us should re-examine our original purpose in how we respond to the Rebbe’s directives and his living example of how to behave; even when immersed in tremendously challenging situations. In this difficult world of Golus, we should strive to re-embody this elevated position where we collectively express love and unity without restraint, and control our base instincts to foment dissent and increase strife. We are much better than this and personally my prayers are continuously offered for a “human revolution” within Crown Heights, culminating in a community embodying brotherhood. In order that we may be seen as the future of society, and not, G-d forbid, a laughingstock for the goyim and the apikoros to be amused by.     They are not calling a Rov that, they are calling Braun that – and the point being on their part is that he is not an elected rov.
    You may not realize, but any ruling by the beis din will be deferrable as meaningless due to an Ikul against Braun’s position (and Zaki’s acceptance or lack thereof should be meaningless to anyone concerned about the lying and cheating that went on).

    While I do not think Mr. Braun would ever do a chuppah with a shiksa, one look at Zaki and you can see that it is not a curse, but rather a sad and accurate prediction, that one of his children will R”L marry out.

    CH needs a total reorganization. Otherwise, it will become irrelevant as the real work is being done in the world of shlichus. CH was to be a beacon for the world; instead it is fast becoming an open sewer that is in need of about three hundred tankers of chlorine for disinfection.

    Meanwhile, kids are going off, tznius is at a lower than Modern Orthodox level – and the real immature kids are ripping up smicha certificates.

    The new Vaad haKohol offices belong in the now vacant G building, and that is where Braun and Schwei can have their Beis Din d’Mecharcherei Riv along with Mendel Hendel the gangster. And of course Zaki can be the guard.

    For their Rebbe I nominate the Lasagner Rebbe who is related to Zaki by marriage anyway. Charlie Buttons is way too decent and fun to play around in their cesspool.

    1) The hazmana leDin, signed by people in the community, was received by Braun (and no-one else.)
    2) Mit amol, the people who signed were being harassed. So who knew. who told, and are you a yold? You knew of the harassment (come on you ain’t that dumb) or at least you knew who knew who signed. (Read it twice before you continue.)
    3) Everyone and his dog knew that Rabbi Kraus was leaving for an extended stay in Israel, and issued the hazmana and ikkul right before he left. So he didn’t answer your calls? Is this some kind of Obama trick or Clinton slick or maybe Pelosi shtick? To make you look good and Kraus bad?
    3) We, the one’s who are not as dumb as you think, know that the Rosenberg-Kraus conversation went the other way (also, perhaps) and that Kraus was enlisted to look into issues that were previously (before Rosenbergs Grand Finale) NOT KNOWN.
    4) You also know (or are you takeh deaf on one ear?) that one of those issues is a very serious (and legal) issue which gave Rosenberg a lot of pressure to seriously wonder.
    5) It is obvious (to the not so casual observer) that you gave a date (if only relative) to when you spoke to Rosenberg, so that if/when Rosenberg comes clean in public, and says what he said in private (to Kraus and to others) then your alibi will be “Oh’ that must have been after he spoke to me” (which was very early in the game. It begins to look like Obama might be your student and not the other way around).
    6) Just one request (part of my outreach-mivtzoim): Don’t go out to lunch with your exec-director.

    I have suggested previously that RABBI Braun abandon CH and go back to Australia. Not, CV”Sh, because there is are any issues with him personally (there aren’t!). Rather, because it ill fits his Kovod to wade into the muck and garbage of such a community full of infighting. Yes, we all shed buckets of tears for the family in Itamar. Yet, far too many of us do far worse to our own brethren on a regular basis here.

    1.) R. Mangel is a candidate then he isn’t
    2.) This R. Braun is presented as a qualified candidate.
    3.) People are fooled into voting for R. Braun by character assassination of R. Bugomilski.
    4.) Somehow a letter from R. Mallow AH surfaces that R. Bugomilski fought with R.Marlow. A letter supposedly was not meant for the public.
    5.) R. Rosenfeld approves rent receipts as legitimate proof of residence.
    6.) It is found that R. Braun has a questionable smicha.
    7.) Some chicanary about what is the status of his smicha
    Did another Rav Give him smicha or was it only a recomendation.
    8.) R. Braun is brought to Crown heights for a hachtara.
    9.) Tamir is warned by R. Osdoba not to sing a contract until the questions are clarified.
    10.) A contract is signed anyway by the other two members of the Vaad. Hackner and Brownstein.
    11.) An Ikul is issued by R. Kraus because no Rav from Chabad wishes to be involved.
    12.) The Ikul is ignored (Who listens to Daas Torah anyway)
    13.) R. Braun comes to town and the so called Smicha document is conveniently destroyed by a chasid who claims to be very devoted to the Rebbe MH.

    Zaki is full of it. He was clearly told, and agreed to not sign ANY CONTRACT until Rosh Chodesh Adar the Ikkul was before that so don’t say everything was signed.

    2nd Braun is not the Rov of the community I live in he is an opportunist who needs an income so why not screw a community out of family purity he will pay dearly.

    Zaki bullies his fellow members of the Vaad and sometimes he is unable to convince Hackner to kiss his feet so he just puts him by the way side.

    Finally there is Rosenberg who laughs at crown heights and hopes for a melt down so he could make more money on another battle. He’s a fake and I’m sure he’s sinned in many different ways.

    Zaki, Braun, Hendel, Rosenberg and everyone else messing with the community, TIC TOC…….

    You are absolutely right! I have personally commented with the exact same comment on two websites (crownheights.info and the “other” one). It was a little controversial and guess what? Crownheights.info published it and the “other” decided not to. Only this has happened so many times that the only reason I still post on the “other” is because I get a kick out of how laughable and unfair they are. Media bias is not new to America but it will never work in Crown Heights. We are too small a community and people talk. Any sane person knows that the “other” website is extremely biased and can always be counted on to give ONE side of the story.

    That being said – it is wrong for a Jewish website to print a comment with the words “yemach shemoi” referring to a fellow Jew. Braun may be a Rabbi, maybe he is not. He may be a legitimate contender, maybe not. But he is definitely a Jew, and for a Jewish website to publish something like that has nothing to do with freedoms or media bias. It is equivalent to my writing comments about the greatness of the KKK and having this website publish it. Its just not right. All considered however, my issue is not with this website. It is with the commenter.

    To the author of comment #1 – I like Braun less than you (believe it or not) but you are a total putz for writing that about a fellow Jew on THE SAME DAY that we have brothers and sisters being buried in Israel. SHAME ON YOU!
    Grow up and stop taking this whole issue to extremes. You will hopefully have chosen not to support him with your support, finances, or questions, but to put your aggression for him before your obligation to love him displays a total lack of education – both Halachickly and ethically.

    The question I have for all commenter on this website is: “What for?” Clearly principles of Torah and guidance from the Rebbe don’t matter. So what are you fighting for?

    For every comment on this website how many of the next generation will just go off the derech, and not take any of the (so-called) adults seriously? Why would they?

    Where are your priorities? You spend huge amounts not only on Kosher food, but specific, mehudar food, shabbos meals, on clothing (kapote, hat, sheitel), on school for the kids, on having so many kids. All for what? Just your social group? Just because the neighbors do?

    A 20 year old girl today has no memory of the Rebbe, and her eventual husband likely won’t either, all her friends are going to college (R”L) or thinking about it, and the vast majority of her friends don’t dress according to Halacha, let alone according to the instructions of the Rebbe.

    What she knows about Yiddishkeit, about Chabad, about the Rebbe, are the things she sees in the people around her. What does she think when she sees this forum? What are you thinking?

    What kind of next generation will they raise? Do you care?

    To No. 40:

    Each one should raise his or her family in the right way.

    Baroch Hashem, my children at the age of two were able to point to my Rov and say, “Tatty, heres our Rov” (as they also can point to the Rebbe and say “this is the Rebbe”).

    Just two weeks ago, I mentioned to my children (3-4 years of age) on Friday that Sunday we will go to the Ohel to Davven.
    Comes Sunday I was not feeling up to it. It was my 3 and 4 year old which pushed us to go.

    Good and evil, right and wrong always existed, it’s not something new. How have we dealt with it all these years (from when Adam eat from the apple)?

    The Torah is full of stories of good and holy people doing not so holy things. The Torah puts those stories there to teach us a lesson.
    DON’T PUT YOUR FAITH IN MAN, PUT YOUR FAITH IN HASHEM AND HIS TORAH!
