Court Battle Over 770: Who Brought Who to Court?

Much talk about been generated over the controversy of the 770 court case leaving many with questions if it will ever end, or how it even started to begin with, and who brought whom to court?

Much misinformation has been spread about each of the parties role in this court case, with accusations that Merkos took the Gaboim to court. Archived documents reveal the true events leading up to this date.

On December 10 2004 Merkos entered court papers seeking a permanent injunction against the group of Bochurim who replaced the plaque over 770’s corner stone with one bearing their version. These papers named only those directly involved in the affair, which led to a melee that required police to breakup.

Ten days later the Gaboim responded to Merkos’s filing against the Bochurim and seeking that they be allowed to intervene and that the case should be dismissed since Merkos failed to include “a necessary party”. (see excerpt)

The Gaboim further requested that they be “joined in as a party to this dispute”

The Gaboim went and asked the Merkos not be allowed to argue their case, and that the Gaboim should be allowed to do as they see fit on the premises including affixing whatever plaque they want to the exterior of the building.

This action was brought fourth by Zalman Lipskier, and supported by Abraham Holtzberg along with Menachem Gerlitzky, all of whom were reelected as Gaboim.

With clouds of an appeal from the Gaboim looming, and the potential of this case to drag out for a number of years to come, the word in the Mivkah is that the Gaboim are at odds amongst themselves, and it is not clear who is calling the shots. Though the overwhelming sentiment in the community is that people want this issue come to an end.

    It belongs to krinsky thats it they should give it up, with the gaboim in there its like the bronx zoo, shluchim are enberrest to bring their guys there its crazy they could only bring them to the ohel, if krinsky takes it over he’ll try he’s best to make it better.

    they both withdraw from court NOW (just the gaboyim withdrawing and giving up the shul to merkos is not what everyone wants)

    any they both agree to a 5 rabonim Zabla (with a time frame each side has 30 days to pick rabonim and the 4 rabonim habe 30 days to pick a fifth etc)

    leave the status quo gaboyim run the shul and merkos owns the building…. until a psak

    The current Gabbyim stole the communities vote.
    We all went out to vote for them with intention that they would end the court case giving the Shul back to Aguch/Mergoz. This they did not do.

    They stabbed the community in the back.

    i for one would not have voted for Gabbyim had I known they would do this, Im sure many more agree with me.

    If the community wanted this they would have voted for the other fanatics running, that we didn’t.

    It’s a dirty shame to use our vote/trust this way!

    It should be clear to anyone who thinks with his Chabad equipment and not his emotions (possessiveness is an emotion, just as patience is – Hod, this weeks haftorah connection).
    Moshe at #4 has the basic idea.

    HOWEVER: Who holds the insurance policy for the downstairs (and upstairs) ever-growing hazard (R”L) of overpopulation? Is there no limit to the crowding?

    These jerks on both sides wasted community funds for lawyers and frivolous law suits and don’t have a bit of regret, or concern for the poor of our community.

    I’m sure the cost has already been hundreds of thousands of $$

    And to pay for their insane and egotistical power trips they charge huge amounts for seats (raising the price every year) and have the Chutzpah to claim that it’s Tzedaka for the Shul. Riiiiight!

    I’m SOOOOO happy knowing that my “tzedaka” will pay for 2 hour’s time of some hotshot lawyer who’s laughing himself all the way to the bank

    Are we EVER going to get people in charge who have a modicum of BASIC Yiras Shamayim???

    (p.s.I know I don’t have to daven in 770…)

    Did anyone go out yelling “lets go to beis din, lets go to a rov” before the tzfati hoodlums went and removed the plaque and ram their own beliefs down everyone’s throats?

    Think about it, this stone was the same for 10 years before Thaler, Frishman and Sharf went and did whatever they pleased, without any permission in advance I might add. No one cared that it was erased and the status quo remained.

    So essentially, it was the tzfati mishechistim that brought this on themselves, and now that they are getting crushed in court, and the rabonim are no longer supporting them in court they are trying to spread this idea that the Chabad hierarchy is wrong for ‘wasting money’ in court.

    STOP BLAMING THE VICTIMS! START TAKING THE AGGRESSORS TO TASK! HOLD THEM ACCOUNTABLE!

    Enough of this already.

    After a few years of not davening in 770, I happen to be there for shacris a few shabbosim ago. I could not believe my eyes when I saw a three foot digital sign flash on and off with Yechi throughout the davening. Whether such a sign is permissible on shabbos I will leave that to the rabbonim, however the sign made 770 look like a stadium rather then a shul…As the old saying goes, “The inmates took over the asylum.”

    We all normal people voted for him for we where assured he would do the right thing.
