CROWN HEIGHTS, Brooklyn [CHI] — No one ever believed that the two fighting factions would ever go before a Beis Din to settle their differences, one side is now saying that all they are doing is “pulling a trick” and are not taking their actions out of court.

The “Schwei Faction” and “Osdoba Faction” have gone in an all out brawl when one side decided that new elections are in order, and went ahead to do so. The Beis Din then issued a letter saying that “…one should not vote in these elections (for Vaad Hakohol etc and Gaboim) for the simple reason: the idea of elections is to give an equal opportunity to upstanding and honest individuals to be elected to the important role of Gaboim and community activists. In the present situation there is no possibility to maintain this fundamental provision.”

Much ink has been spilled since, both in court and in the news articles, and in the present day the two factions are bound by a panel of Rabbonim, an arbitration panel, who’s ruling on the matter will be final and all parties are to abide by it.

As part of the agreement to enter into this process of binding arbitration, better known as the Din Torah, it was both parties duty to remove their actions from the secular courts. One can understand that taking someone to court in order to compel them to appear before a Beis Din, but once that happens it is becoming of the parties to immediately remove their actions from court and leave the ruling in the hands of the Beis Din.

“Here they are pulling a trick, they are willing to take the action we brought against them out of court, but parts of their actions, their Mesira, they want to leave in court” said Yosef Katzman, a representative of the Osdoba side. “They never even had permission to go to court in the first place!” he added.

“All we want to do is keep the status quo” said Eli Cohen, the executive director of the new Vaad Hakohol, in response. “It’s a matter of negotiations and it is really no big deal.”

So far Rabbi Avrohom Rosenberg, who is presiding over the Din Torah, has been made aware of this, but he has not issued his opinion, which would constitute a ruling, on the matter.

“Do you know how many people did not have money to make Yom Tov?” asked a source close to this Din Torah, referring to the subpoenas the new Vaad issued to a local Gmach and business in attempt to understand the finances of the old Vaad. “Everyone ran to take their money out of the Gmach when they heard that there was the court action coming against it.”

Stating that as his basis he said that this is but one of the reasons all the actions must be entirely removed from court, “without any monkey business” he concluded.

There has been speculation that the din torah will conclude sometime in around Pesach, but there has been no official timeline from Beis Din who is now trying to work out a schedule for all the Rabonim to meet in person.

    Mendy, its actually called binding arbitration for a reason, How is it binding? By the fact that any ruling is enforceable by the authorities, and by the fact that anyone who will defy the ruling would be subjected to harsh penalties (haha).

    As stated above there is a emergency Kinus tonight & this is what is being talked about??? Tue or not both sides agreed to this Bais Din Zablah & both side chose The Rabbonim they wanted as Dayanim If & when ch”v one side decides not to follow the ruling then they are for sure guilty & should be immediately & permanently banned from anything to do with the Schuna other than the house or apt. you live in.I would then suggest that they permanently leave the schuna & start their own new neighborhood etc. else where!

    the only thing that is still in court is the TRO that some people are not allowed to come in to the offices of the vaad hakohol and the rabonim for obvious reasons and that should remain that way until the din torah is over

    Status quo is right. Only because of the vaad’s actions in court were they able to pull off this din torah and get it to count as arbitration. The only way this din torah will count as such is if it still registered as the solution to the pending complaints. It is what binds the other side…
