With regard to the injunction, the Appellate Division yesterday issued a “stay” of the “TRO” to the four persons who appealed, those being Respondents Yisroel Best, Yisroel Sandhaus, Yisroel Landau and Eli Poltarok. As none of the other 14 Respondents (candidates) appealed the injunction, a very strong argument can be made that the Appellate Division's Order does not protect or apply to them. The other 14 Respondents are: Kalman Bialestock, Fishel Brownstein, Zev Cadaner, Yossi Keller, Yossel Motchkin, Yaacov Rogalsky, Mendel Shagalov, Chanina Sperlin, Zaki Tamir, Uri Niazov, Gershon Chaimson, Motel Chein, Zalman Lipsker, and Y. Boruch Spielman.

Dear Dr. Lang:
You asked me for an advisory opinion about the current status of the Injunction (T.R.O.) that we obtained tins past Wednesday restraining tile Sunday elections called by Yisroel Best, as well as tile lawsuit in general as it pertains to the elections.
With regard to the injunction, the Appellate Division yesterday issued a “stay” of the “TRO” to the four persons who appealed, those being Respondents Yisroel Best, Yisroel Sandhaus, Yisroel Landau and Eli Poltarok. As none of the other 14 Respondents (candidates) appealed the injunction, a very strong argument can be made that the Appellate Division’s Order does not protect or apply to them. The other 14 Respondents are: Kalman Bialestock, Fishel Brownstein, Zev Cadaner, Yossi Keller, Yossel Motchkin, Yaacov Rogalsky, Mendel Shagalov, Chanina Sperlin, Zaki Tamir, Uri Niazov, Gershon Chaimson, Motel Chein, Zalman Lipsker, and Y. Boruch Spielman.
The Court of Appeals, the highest Court in New York State, has long held that the Appellate Division has no power or authority to grant relief of any sort to a non-appealing party, even when the issues are exactly tile same. Thus, in the Court of Appeals case of Hecht v. City of New York, 60 N.Y.2d 57, at 62 (1983), where the City appealed ajudgment and tlleir co-defendant did not, the Court held, and I quote in excerpts:
“an appellate court’s reversal or modification of a judgment as to an appealing party will not inure to the benefit of a nonappealing coparty unless the judgment was rendered against parties having a united and inseverable interest in the judgment’s subject matter, which itself permits no inconsistent application among the parties *** When multiple tort-feasors are found to be liable for damages, they may not be said to have an inseverable interest in tile judgment, even though the factual basis for each party’s liability is identical. *** This court now holds that neither CPLR 5522 nor any other statutory or constitutional authority permits an appellate court to exercise any general discretionary power to grant relief to a nonappealing party. ***
Judgments are no longer necessarily viewed as indivisible entireties, reversal of which as to one of the parties necessarily effecting a reversal as to all parties against whom the judgment was rendered *** CPLR 5522, therefore, should be read in harmony with the statutory scheme which limits an appellate court’s authority to the grant of relief to those who have appealed, except as discussed above.”
In this case, the Honorable Justice Laura Jacobson of the New York State Supreme Court issued an injunction restraining and prohibiting the Respondents in the lawsuit from “holding, conducting or participating in the elections presently called for May 24, 2009.” As the Appellate Division stayed this T.R.O. as to Mssrs. Best, Sandhaus, Landau and Poltarok, these four individuals cannot be lawfully kept from holding elections, even though doing so is in direct violation of the Beth Din of Crown Heights’ several Orders directing them not to do so.
However, it seems to me that the other 14 Respondents cannot and, indeed, are prohibited from participating in the days events, and any results from the elections, at least until the June 3rd hearing on the pending lawsuit, and that these 14 persons would in fact risk a contempt of court finding if they did participate. They chose not to appeal Justice Jacobson’s Order, and they therefore cannot now seek to benefit from the relief obtained by those who did.
In any event, the lawsuit, which simply seeks an Order from the Supreme Court to enforce the Psak of the Beth Din of Crown Heights prohibiting the elections, continues with all due force and effect. On June 3rd the issues will be heard by the Court and, hopefully, decided in favor of the Vaad Hakohol – which seeks from Court only to enforce the Rabbi’s 3-1 majority Psak In this regard, Eli Poltarok successfully submitted to the Appellate Division, by written affidavit signed by him, at paragraph 11 of his affidavit, that “no harm would result from the election as it can be contested thereafter.” As Mr. Poltarok correctly pointed out, and certainly must adhere to, there can and will be no effect nor enforcement of any results of the election until tile Supreme Court gives it’s stamp of approval. Of course, we believe it will not, and, in fact, the elections will be nullified retroactively, but all this will have to await the final outcome of the court proceedings.
I hope the above clarifies matters for you. I presume, based on his representations to the Appellate Division and his standing as a law abiding member of the community and the legal Bar, that neither Mr. Poltarok nor any of his colleagues for that matter, will seek to cause any unrest before the State Supreme Court makes it’s determinations. Over a year ago members of Shomrim were on a call at 749 Eastern Parkway, there, things got out of hand and police were called by both the Shomrim members and the Bochurim that were involved. From the get-go Shmira a long time rival of Shomrim came to the scene and initiated the Mesira against Shomrim. Leib Skoblo and Ezra Hecht (who only showed up after the incident) stood inside 749, Skoblo with his auxiliary badge in hand demanded that the police arrest Shomrim for the alleged crimes they committed.
The police investigated and with no injured complainers on hand, they left the scene. Skoblo not comfortable with the police decision then called for Stern, Prager and Huebner for backup. All night they shuttled Bochorim in the Shmira patrol car from 749 to Kings County Hospital. They made sure reports were filed with the hospital and then the police were called again to make reports. They made sure they doted their “I’s” and crossed all their “T’s”. In an e-mail conversation with a Shomrim member he states…” Had Shomrim known of there plans they would have made cross complaints, as there were members of Shomrim that were injured, and everyone would either get arrested or go home. Further had shmira not have gotten involved, Shomrim would have worked it out with the Bochrim in a peaceful manner”.
For two weeks Paul Huebner, who acts as the attorney for Shmira, worked the 77th precinct , pressuring detective Brien Duffy to arrest the Shomrim members. Shuffling the Bochurim back and forth to the police station, even giving sworn statements on Shabbos (all this is documented).
When word got out about that detectives were looking for the Shomrim members, Shomrim turned to Rabbi Schwei, a prominent member of the Rabbinical Court (of Crown Heights) for help. He heard all that they had to say and simply answered ” I don’t want to take such people on” (!?)“
When Shomrim went to Mendle Hendle (who is in charge of these Bochrim) he said ”I want to teach you guys a lesson“.
To others he said ”I want to get Krinsky so I’m going after the Shomrim”. What does Shomrim have to do with Krinsky? g-d knows.
Voting in this elections is voting for Hendle,
voting for Hendle is voting for total destruction.
Let’s deal with one problem at a time, but in the meantime let’s not create more (we have plenty).

According to the Netzigin ByLaws, anyone who heads any organization or Mosad in CH is disqualified form running for CHJCC Board of Directors / Vaad Hakohol.
Kadaner runs 2 meshichist Schools in CH, one for boys Ohr Menachem and another for Girls Beis Chaya Mushka.
It’s a conflict of interest to have someone who needs money for his schools siphoning off money form the CHJCC funds for his own Mosad.

Rabbi Schwei also got involved in the story with the camp when he shouldn’t have,He signed a psak for spritzer even though he was not at any Din Torah. When asked about it he said that he made a mistake (that osdoba told him to do it), but he never came out (with a letter) taking back what he did. The damage was done, because of him Hundreds of Children from our community lost out on a great opportunity to go to camp.
