
Chabad Vs. Lichtfield Dispute Heading to Court
Attorneys representing Chabad Lubavitch of Litchfield County have taken direct aim at Litchfield’s power to regulate construction within the town’s historic district, and the argument will come to a head this week in the Bridgeport courtroom of U.S. District Court Judge Janet C. Hall.
The Borough of Litchfield’s Historic District Commission rejected in 2007 an application to expand a 2,656 square foot, 19th century West Street home, most recently used as a business, into a 21,011-square-foot synagogue and community center.
Attorneys representing the town and individual commission members have argued repeatedly — and unsuccessfully to date — that the town’s decision was constitutional, commission members are protected by immunity, and that key elements of the 2009 federal discrimination suit should therefore be dismissed.
On Friday, attorneys will make oral arguments supporting fresh motions from all sides seeking summary judgment, or a ruling from the judge that would decide the case without a trial.
