Appeals Court Upholds Decision to keep Rubashkin in Custody

Former Postville meat plant executive Sholom Rubashkin should remain in custody prior to his sentencing on 86 financial fraud charges, a federal appeals court ruled today.

The U.S. Eighth Circuit Court of Appeals upheld a judge’s decision to hold Rubashkin without bail, before he is sentenced on financial fraud charges.

Rubashkin, 50, was convicted in November of charges that included mail, bank and wire fraud, making false statements to a bank, and failing to pay cattle providers in the time required by law. Prosecutors have said the former vice president at Agriprocessors, Inc., faces a recommended prison sentence of 21 to 27 years.

Agriprocessors was the site of a May 2008 immigration raid that led to the arrest of 389 illegal workers, bankruptcy, and charges against Rubashkin and other managers. Rubashkin has maintained innocence.

A sentencing date for Rubashkin is not yet set.

    in the news this week, there were two men who were released from prison after 7 and 8 years of serving. reason for conviction: murdering their father. Rabbi Rubashkin is NOT a murderer, the punishment is completely out of proportion to the crime!
    let us say more tehillim and surly he will prevail!

    Unfortunately the federal courts are very conservative. It’s not the person it’s the crime and the 86 counts he was convicted of.

    The government is determined to set a precedence that will detour future employers from these types of crimes. It is evident from the recent spate of civil crimes, Madoff, on wall street etc. that the people and courts are fed up. Sadly Sholom was swept up into all this at this time.
