We are gratified by the two New York Appellate Division decisions issued yesterday to uphold the ruling of the New York Supreme Court which unequivocally affirm the full ownership and complete rights of use of the synagogue located inside the 770-784/788 Eastern Parkway buildings to the central Lubavitch institutions of Agudas Chassidei Chabad and Merkos L’Inyonei Chinuch, Inc.
In 2005, after Merkos L’Inyonei Chinuch obtained a Temporary Restraining Order against a group of individuals who had defaced the premises, an entity calling itself Congregation Lubavitch, Inc. (CLI), injected itself into the judicial proceedings, claiming exclusive rights of control of the premises.
In its rulings yesterday the Appellate Division of State Supreme Court for the Second Judicial Department further affirmed the ruling by Justice Ira Harkavy of New York State Supreme Court granting Agudas Chassidei Chabad and Merkos L’Inyonei Chinuch full right to eject Congregation Lubavitch, Inc. from the premises and assert their full control over those premises.
“We look forward to the implementation of the Courts’ rulings, including the transfer of control from CLI to the buildings owners, Agudas Chassidei Chabad and Merkos L’Inyonei Chinuch” said Donald Kravet, an attorney for Merkos.

To all true Lubavitchers, One can make a Sheceyanu on this good news. In a peaceful and diplomatic way it should be made clear that the nonsense must stop. What happens in 770 has an effect all over the world. Anyone wearing a cultish pin or with a yalmuka that anyone over 9 years old should be embarassed to wear should be told either shape up or ship out. The light headedness and dancing and saying that nothing happened the 3rd of Tammuz is pure denial at best case. Everyone remembers the Rebbe screaming Sukkos time about doing things that cause thousands of people to stop learning Chassidus. Explain to these people that everyone is welcome into the Shul if they follows the rules

First off, you can go Platzen, go dance with your mishichist friends (after all you did win?).
Second: were was your fake, superficial “ahavas yisroel” when I and many other were being beaten up because we were not in line with the mishichist view. (I know, now your going to say “if they beat you up there must be a good reason”).

Throw out all Mechichist books and other articles, take them out somewhere to be burned. Destroy all “yechi” signs inside and out. When ready to reopen, prohibit anyone from entering the building while wearing any Meshichist messages, including on yarmulkas and pins, etc., or distributing Meshichist pamphlets. Those who raise their voices with Meshichist messages must be banned from entering, and this must be enforced. Just one little thing, in the end you wrote…

It is only the mishichistim that find contradictory “sichos” of the Rebbe, I don’t believe that the Rebbe said at one time one thing and then said something else which contradicts the first sicha.
It say “one Mitzva (goog deed) leads to another Mitzva- one sin leads to another sin”.
All these “pasted sichos” have not lead to any good things (nothing good has come out of it), only pain and misery. I don’t think that could have came from the Rebbe (g-d forbid).

The REBBE’s honour, dignity and greatness has been ridiculed all these years by an attitute of spite and a camp-like behaviour which has no place in 770; the most important shul in the world. I am not against “meshichisten”; I appreciate their fervour to the “cause”. Something many of us could do with more. Any Lubavitcher or aspiring Lubavitcher, knows and feels that were Moshiach to come today, that person would be our beloved REBBE. And were HKB”H decide otherwise, as ultimately we no nothing of HIS way, then whomever Moshiach will be, shall be by every Yid accepted and celebrated. What I am not confortable with thou, is the imposition of feelings and convictions on others and in places where some may not be confortable with. Nothing would happen if thoses signs and flags and pins etc were not worn or put up. But what is clear on the other hand thou, is the damage caused by forcing these on others who may not be comfortable with them, the fact that most Shluchim cannot bring people they are working with into 770, lest they see what social conventions deem odd, cultish and extreme behaviour. There are many mitzvois and acts that may be right and just, but are not to be performed in public. In your own home, put any signs, banners, proclaim anything that makes your Avodash Hashem more fulfilling, but in public places and particularly in places that do not belong to you, you should never impose your feelings and convictions beyond what has been explicitly stated in Halocha and beyond what our Mihoghim dictate as stated in our seforim endorsed by none less than the Rebbeyim themsleves. Shaving the beard may be permitted by some, but growing it is definetly the surest way. MESHICHIST behaviour may be right or may be wrong, but refraining from it will surely make 770 a place where EVERYBODY will be comfortable and happy.

Everything will stay the same because Aguch and Merkos are two wimpy organizations headed by a bunch of A.K’s who are afraid to act upon the powers given to them by the court decisions. The Rebbe has given them one victory after another and yet everything stays the same. The squatters who have taken over 770 see the weakness of Aguch and the Merkos and are mounting one appeal after another and the lawyers are having a great time making money from the zedakah money collected by these organizations over the years. We ask the leadership of Aguch and Merkos step aside and let some young blood take over the leadership. You have betrayed our trust and the Rebbe’s trust. You had your chance let someone else take over.
