Shochet Still Incarcerated – Tehillim Needed

POSTVILLE, IA [CHI] — Tal Ginter was incarcerated during the Agriprocessors raid and unfortunately has had to spend Shabbos behind bars. Some Shluchim from Postville visited him Friday to bring him food and lift his spirits. We are asking that in the spirit of Ahavas Yisroel that people should please say Tehillim as well as do some extra deeds of goodness and kindness, so that we can speed up his release.

    It is legal to get a visa to work in the US. (It is time consuming and difficult-deal with it!)

    It is legal to buy insurance.

    It is legal to have a drivers license.

    It is legal to immigrate to the US-there is no reason to sneak into the country.

    Somehow, we have developed an attitude of Torah’s laws are the only real laws and the “goyishe” laws, they are meant to be circumvented. That may have been good in Russia, but here in the West, we CAN do things legally.

    So often we hear of saying Tehillim for someone who broke the law…WHO COULD HAVE DONE LEGALLY!

    (let me predict how this will be answered: “This is not the time to preach. We have to get our fellow Yid out of jail” Let me ask, when is it time to preach? I preached in my first paragraphs. Has anyone listened?

    Maybe it would be smarter to leave out things you really don’t know about…aka Jonathan Pollard.

    The campaigns for his release have nothing to do with whether or not he is guilty. Of course he is guilty and he plead guilty. But the injustice is that he was arrested for one crime–espionage–and he plead guilty, the average sentance is 2-4 years and no one has ever served more than 7. He was convicted of another crime–while he was being tried for espionage–and he was convicted of treason–which couldn’t really happen because the nature of treason is giving information to an enemy nation and Israel clearly doesn’t fit that form. He was sentanced to life in solitary confinement–a punishment that no one has ever recieved for the same crime.

    The Jonathan Pollard campaigns want him out because he was cheated out of a fair trial by anti-Semites in our government. His sentance is extreme for the crimes committed–and no one with the same crimes served as long.

    people who committed similar crimes had a much lighter sentence and Jonathan

    While he may have broken the law, he is still needing & desrving of our help. Instead of blaming Tal, we should all be pointing a finger at his employer. They should have made sure he had proper papers or obtained them for him. How can we trust Rubashkin kashrus if they are only out to make a buck??

    I don’t think anyone here is suggesting that R. Ginter rot in jail, R“L. I think we all want to help him and understand that he is probably caught in a situation beyond his control and had no idea what he was getting into at the outset. I suspect that his American ”handlers“ never expected ICE to come down as hard as they did last week.

    Is this really a case of Pidyon Shevuyim? There is no conspiracy against him personally or against Jews in general and it is highly doubtful that he is in any grave physical danger. Also, there is a strong likelihood of violation of the law pertaining to Homeland Security; a govt. function established in the wake of the bloody 9/11 attacks on our home soil!

    Yes, we should be concerned about a fellow Jew who is in trouble and strive to help any way we can; food, clothing, tefillin, legal advocacy, daven on his behalf etc. However, let’s not get carried away assuming that there is a Torah directive that supersedes the Dina DeMalchusa.

    I am married. I learned in yeshiva with Tal. He was an Incredible person. Always friendly in Morristiwn. ALways made an effort to make others happy and smile. He would get up at rediculous hours to learn chassidus before davening. I would put my trust in his shchita any time any day…

    Until he was arrested, he did not even know his green card was canceled.

    Next time you judge somebody, make sure you know the story behind it as you know when you judge somebody you are actually judging yourself, so be careful.

    Visas, documents, immigration papers are something that many people neglect and don’t realize that they could get in trouble over it. Americans do the same thing in EY. I think this guy figured that the government would never look in his direction. How many of our kids are running around all over the world without updated visas? I spoke to some mothers who remembered that their kids were also running around without papers. Don’t judge this guy.

I worked for Rubashkin and you can say about them whatever you want, but they all have a big heart and I am sure they are working on this case non stop.     And by the way, al pi din, the obligation of pidyon shvuyim applies also to the case in which one is absolutly guilty (even of transgressing the almaighty US government’s law).

    No one is judging Tal. The comments you don’t like are comments about the system. Comments about the general apathy towards anything but Torah law. Of course, we should help the guy out. But this is a lesson to everyone to be vigilant about their working immigrant status. To be sure to follow the laws and to follow up. Same with the Rubashkins. Why isn’t anyone upset with them? They created this mess. They know better.

    Should we show Rachmonus to Tal? Absolutely. No question. It was stated that he didn’t break the law. However, even if he had, we still have to feel sorry for him and try to help him. We can’t have the attitude of “Let him rot in jail for breaking the law.”

    My point was something totally different. It was, Chevra, we have to obey the law and not think that because we are Jewish, Chassidim, Lubavitchers or whatever we don’t have to live a straight life.

    As I said, it is legal to purchase insurance.

    However, their parents have to realize that this stuff is serious and needs to be taken care of. It can’t be brushed off.

    One thing I will never be able to understand is that when a person who KILLS or BEATS someone, which is against the law and a person who simply didn’t fill out his paper work (Which is also against the law) can be treated the same way.

    One is a criminal/violent person.
    The other one broke the law but is a pretty much decent person but gets treated the same way.

    For example one did tax invasion, the other is a Cold-blooded person, but gets treated the same way.

    I feel for you and your naiveté.
    You obviously know very little about the immigration procedure, which makes it nearly impossible to obtain a visa in the post 9/11 America. I am a U.S. citizen and I appreciate our freedom and opportunity, however I also appreciate that many other countries do not have the luxury of making ends meet (even after working multiple jobs). I would not be careless or pompous enough to flaunt my advantages, by merely being born in this country, nor belittle another’s strife due to being born in a different country.
    America is by definition a land of immigrants.America was a poor nation until it opened it’s doors in the late 19th century, and developed an immigrant workforce.
    I believe that we must follows the laws of the land, but I also believe that “all people are created equal” and that means; if I have a right to live free so does everybody else. It would do you well to take a little ride to the Statue of Liberty and read the small plaque at her feet.
    I would also appreciate a reply.

On one hand, People should be more creful in the future and take the visas and government more seriously in the future. And even though this is negligent on the part of the shochet. However, the BOTTOM LINE IS that he is in jail and ITS A BIG MITZVAH to release FELLOW JEWS from jail. nOW, AFTER THE FACT, lets ofrget about everything else but getting another jew out of jail!!!

    Oh please. Keeping the laws of the country is NOT “top priority”, it’s just about the BOTTOM of the priority list. Some commenters here seem to believe that dina demalchusa dina is some kind of ikkar emuna, one would think at LEAST in the aseres hadibros, if not etched into the aron itself! It’s not. It’s an obscure memra in the gemara, whose reason and exact application is subject to wide-ranging speculation among the rishonim, and it’s certainly far less important than principles like ahavas YISROEL and pidyon shvuyim.

    If he’s guilty of some technical violation of some paragraph in the immigration code, that’s between him and the government, but it shouldn’t concern us. We owe him our full support, and must do what we can to help him and to get him out of there – INCLUDING unterkeifen if that will help and otherwise breaking THE LAW if it’s necessary and useful to do so. That’s a mitzvah and a chiyuv.

    Why can we not learn from our own history? Have we forgotten what the Sefirah days are all about? Reading the above commentsyou can only conclude that while there are still Yidden that look at the positive, there are still those out there that will always find the negative and deem the cup half empty.

    2) GUNs AND AMMUNITION read the above. have any guns or ammunitions been purpoted to have been found during the raid? the answer is NO! Lo yonum v’lo yishon shomer yisroel! because we all no their abilities and what stopped them from planting any such evidence obly Hashem knows.
    3) PIDYON SHVUYIM – did anyone take the time to research what truly is the story about this Schochet that is still incarcerated? did anyone stop to ask that if the Rubahkin’s do not care about the law and their fellow yidden then why is it that from a whole plant with so many Shochtim and Mashgichim there is only one idividual person that has allegedly run afoul of the law? hardly an epidemic or a disregard of the law on the part of such a huge operating plant. The fact however is that he had legal papers for mamy years and his Lawyer (unfortunately Jewish) kept on taking mony from him for the several years but did absolutely nothing in having his visas extended and / or status changed! He was constantly told by this unscruplous Attorney that all is fine and in order when in fact he never did a thing!!! the problem is that the government is unfortunately very accustomed to such low life attorneys and therefore advise you to sue them but as far as they are concerned you did not abide by the law!! Hardly and argument to portray the Rubashkin’s or the Shochet of intentionally diregarding our laws.

    Boruch Hashem that there are many yidden still out there that are doing everything they can to have him released and b’ezeas hashem they will succeed!

    i went through the green card process myself (married an american) and when i changed my address and sent a letter to the immigration, thier system didn’t process it.

    i was lucky that i went through a lawyer, so when they sent me an appointment, my lawyer got it too and notified me.

    when i went down for my appointmetn, they asked me to verify my address, and they had my old address! when i told them i had sent them the change of address form, they said, “oh yeah, we never get those…”

    so a lesson we could learn from this, is go through a lawyer!

    If you read the comments on the original article about the immigration bust, there were a lot of negative comments on illegal Mexican workers. Someone pointed out that Mexicans are not the only illegal immigrants in the country. Evan someone who over stays their visa can be considered illegal. The comments on the article were assuming that the illegals were Mexican— and some comments actively cheered on the government for stepping in and sending them back regardless that these individuals had families etc.

    The comments on this article bring about a very different response. So yes, in this case he’s Jewish. Yes you’re not supposed to leave a Jew in jail. And yes, this poor man’s family. But what about the families of the other men (and women?) caught in the immigration bust?! People were so quick to say, “Send them back to their country.” Until it hit home. Like here.

    To anyone who is AMERICAN and doesn’t realize how HARD it is to get a visa more than 5 years – being able to stay in this country is not easy at all – I myself have had a visa for almost 5 years, applied recently for a green card so i could stay, and now realize i can’t stay until i get the green card (and by the way, getting a green card is a crazy thing in itself) – so I, together with other foreigners, do not want to have to leave the country – but am stuck – because if i do stay here, i could get in the same trouble. but to know that i’d have to leave and not be able to come back for about 4 yrs – when my whole life is here????
    DON’T JUDGE – these are not easy decisions.

    I did not read the Ma’ariv but I read the Des Moines Register and a lot of other Iowa news sites and no one said Agriprocessors was a front for a Meth Lab or that Guns and Ammunition where at the plant.

    Wat it said was that some Employees where running a Drug & Meth shop there. When you own a slaughterhouse where 600 or more of your employees have no outlook of going anywhere but maybe make another dollar an hour you will for sure have a bunch of these people get into drugs. These people have no papers so their changes of a better life in Iowa are not very great.

    It was reported that some employees took weapons to work. Weapons can be anything. It could also be knives. They where working in a slaughterhouse and didn’t have to go far to get hold of weapons of that kind.

    Many people are questioning the “Kosher” status of issues brought to light in the recent Immigration Raid in Agriprocessors. More than any of these issues, it is unKosher to assume guilt when an accusation is made. This is a cornerstone of justice – presume innocence until guilt is proven…

    This is definitely the case when the accusations that have been made are based on sources which contradict themselves and each other throughout the affidavit, display shocking ignorance of the plant and its operation, and make claims based on hearsay that stretch the limits of belief. Two small examples of this:

    Someone claiming to be an employee and identified as Source #11 speaks about turkey processing operations, which take place on the south side of the tracks that run by the plant. He was shown a map and identified a number of buildings as being where the turkey production takes place. He knows this because he has friends that work there. The same claim is made by Source #7, who was also shown a map and identified a number of buildings on the south side of the tracks as being used in turkey processing.

    A few years back Rabbi Tal Ginter was issued a “Green Card”, as required by law when one moves, he submitted a change of address to the immigration office and then moved to Morristown N.J. to study at Y.T.T.L. it was revealed now however that the immigration office kept sending his mail to an old address.

    Until he was taken away by the I.C.E.(Immigration and Customs Enforcements) Rabbi Tal Ginter had no idea that in the meantime they revoked his green card, since he did not show up for his appointment (Gov. sent it to old address) and they went ahead and passed a Deportation judgment against him.

    Even government officials here agree that Rabbi Tal Ginter should be allowed to go free, but the law says that since he has a judgment against him, the only one who is able to revoke it, is the original judge, and that can Chas V’Sholom take a long time, so basically they want him to stay R”L in prison because of their mistakes.

    This is why we ask everyone to please say Tehilim and give extra Tzedokoh for Tal Ben Sarah, the community has also been in contact with many head Shluchim and L’Havdil Senators and Congress people and other great Askonim on his behalf, so we can get his case moving quickly so he can go back to his loving family.
