Yungerman Arrested After Receiving Double Parking Ticket
At around 5:00 this afternoon a member of Anash double parked his car on Crown St. between Schenectady and Troy to unload luggage, he had just arrived from the airport for a stay in Crown Heights, when a police officer wrote him a $115 ticket.
According to numerous eyewitnesses the trunk and the door was open “basically; it was clear that he was unloading things from his car” and one bystander even approached the officer that was issuing the summons and asked him “Why are you ticketing him? Can’t you see he is unloading?” to which the officer simply ignored him. When the driver came out the officer was just about to leave, the yungerman asked him why did he issue him the summons as it was obvious he was unloading, in which case the office again replied with ignoring him.
The Yungerman decided he will stand up for himself and stood in front of the police car denying the office from leaving the scene. This is where everything went awry. According to by standing witnesses the office got out of his car and grabbed the driver pushing him up onto the sidewalk where he then called for backup and arrested him.
This officer is a dedicated to giving out tickets and has been spotted numerous times giving out tickets for the most minor offenses, and then you wonder why crime is going up.
Later efforts made by members of the community to release him failed and he was processed and sent down to central booking, where he spending the night in a holding cell, and will be released in the morning.
Official statement from the 71st Pct. Is that the car appeared to have been double-parked and there was no sign of active unloading. Another point mentioned is that a police office is not required to answer you, but you do have a right to demand a patrol supervisor, which upon request must be provided.

The same officer wrote me a ticket when I was stopped at a hydrant, standing next to my car. He pulled up, blocked my car so I couldn’t move and got out to write me a ticket. When I said "Please don’t write me a ticket, I’ll move," he said " I already started writing it." He THEN walked over to my car and started writing it. I know how yesterday’s victim felt because I felt like punching the police officer! Two witnesses saw what he did and I am planning to fight it. The normal behavior would be to pull up and say "Excuse me, please move your car or I will have to give you a ticket." But why be normal when you can harass people with your imagined "power?"

Unfortunately, this was not the time for the bocher to decide to stand up for himself. Being that there were witnesses to the officer giving him a ticket and even people asking the officer not to do so, the bocher should have just taken the ticket and then taken down the witnesses’ names and made a complaint to the police chief. He should have also sent a copy of his complaint to the mayor and any other people of city importance.
I don’t know the traffic laws of NY, but I do know that doubleparking is a problem and dangerous no matter where it is done. I’m not saying the police were justified in giving the ticket. They certainly could have given the bocher some slack, but they were within their rights. The fact that on this website and on shmais the bocher’s fatigue was mentioned just shows that he was tired and not thinking straight when he stood in front of the policeman’s car. Considering all the mishigoss going on in Crown Heights, he should have realized that an angry young man jumping in front of a policecar was not going to go over well with the men in uniform.
I am sorry for the young man’s ticket and having to go to jail. But the whole affair might have just cost him $115 in a fine and some anger, rather than having a bunch of cops manhandle him and take him down to the station.

i have an idea/question: what does everyone here think of the idea of bringing a whole bunch of donuts or the like to the 71 pct like for the night shift or whenever, and writing on the box or a note "on behalf of the crown heights jewish community, we thank you etc etc".

How come at this same time on Carroll Street between Albany & Troy from around 4pm untill 1.00 am ( on and off during those hours) there are double parked cars sitting and blaring rap music, youth playing football in the street, throwing the ball at Jewish passersby ( and at my car when I went to move it) and not one cop EVER gives them a ticket! On the rare instances that a cop turns up 45 mins after I call all they do (this has happened twice in 2 years!) is ask the driver to move the car!!!!!

The Yungerman and any eyewitness should file a complaint with the Police Review Board against this officer. It will go on his record and affect future promotions. If there are many complaints the officer may be repremanded, transferred or dismissed.
Also, please attend the 71st Police/Community meetings which occur on the 3rd Thursday of every month. You can voice your concers and talk directly to C.O. Frank Vega. He is there every meeting.
Do something, don’t just sit there.

The policr do not have the right to ticket someone during active loading or unloading even if they are parked in a no parking zone – especially in this case where the car WAS NOT LEFT UNATTENTED.

i was once ticketed for being in a no-standing zone in CH. there was no sign on the side of the block i was n just the side.
so i went to fight it and you know what? i was found guilty!! somehow the judge tells me that if there is one sign on the block whether at the beginning of the block or the end, or even the other side, that is enough.
so i using my CHABAD and knowledge of the Talmud respectfully said:
"your honor, how then do you explain that throughout the whole block you ARE allowed to park, only at the end on the other side are you not as it is a no-standing zone."

I had a similar situation and tried fighting it and they said that loading and unloading is only ok for a commercial vehicle for commercial purposes.
I understanded how the chosid feels. I also felt taken advantage of and violated.

If the police will not give a ticket to a stereo that drives, that is double parked for hours, just because it’s deejay happens to be black, and at the same time will go ticket unloading CIVILians; that is beyond the laws of the land. If you only follow their career for a half a day and watch the ‘simcha’ involved in their ‘mitzvah’..you will see that there is something wrong with it.

I think we have to get organized and follow (quitely) the police who ticket and proove on video how they discriminate. Once we have clear evidence we should make a VERY BIG SHTUREM!! and go with all the evidence to the press etc etc.

same officer ticketed me. i doubled parked on crown and kingston, and left my door open. i walked over to a friend 20 ft away to pick up a bag and when i returned 25 sec. later the cop was alrady there and not willing to hear a thing.. he only said ‘you were double parked’

Thanks for the list of rules in dealing with the police. While I definitely feel bad for the Bochur and there is no doubt that there is selective enforcement of the traffic laws, the police are not ordinary human beings and starting up with a police office is a serious issue. We can not teach our young ppl. to fight back with officers. We must use legal and political means to get action. For all the people who think that the Boro Parkers protest was so smart, can some residents of Boro Park tell us if less tickets are being written now. There would be anarchy if ppl. could fight or talk back to officers on the street! There has to be respect for authority whether they deserve it or not!! Hispalel Bishlomo shel malchus…and do your political Hishtadlus on the side.

The Spider Burglar, on the Upper East (West?) Side of Manhattan, was caught and released 18 times! Great for the insurance industry and criminal justice system, otherwise they’e be bored and poor.
I once worked as a Police Administrative Aide for the 76th and 67th Pct. One officer regularly parked next to a fire hydrant (I know his name). Once, on Utica Avenue near Flatbush I saw a police officer throw an empty box of Marlboro cigarettes onto the street (littering is illegal – they don’t enforce those laws). Standing next to the viber’s shul of 770 on Kingston I saw a bus driver, who stopped for the light, open his window and toss out a paper plate. I’ve seen numerous police cars without one headlight. Yes, they’re not angels, and their not careful with the law.
I don’t trust the police or government. Look what happened during the Pogrom. Nobody cared: City, State or Federal governments didn’t do a thing to protect their citizens, even though there was a murder on the first day. It was allowed to continue 3 more days. Perhaps there would be more murders? But, dear citizen, don’t forget to buckle up, you might get hurt!

I came out on my porch on time to see around 5 police officers putting this man under arrest. I could not believe what I saw! They twisted his arms backwards as if he was a murderer CH"V. There were a few police women laughing & Shvartzes screaming that it was the right thing. They couldn’t care less when someone calls for help but this officer called for assistance and in seconds-the ENTIRE block was FULL of police cars. Those who say he deserved it should think what they would do if they were in a situation like his- if you wouldv’e seen the face of his wife,mother and family-poor them-they just came off the plane for a simcha and look what happens. It’s totally ridiculous that this is going on.

I just was pulled over on Kingston. When I got out of the car, the policeman said that I should never get out of the car if I’m pulled over, "because it could be dangerous for you." I was questioned beligerently while they fished for some other illegalities before they told me they were from the Traffic Safety Unit. They then gave me a $40 ticket for not wearing a seat belt.
Then they got into their car, and sped away up Kingston, dodging in and out off traffic at breakneck speed, making a wide left onto President (due to the unsafe speed), and sped off into the horizon.
Traffic Safety? Are there statistics as to how many black residents of CH receive tickets for such violations?

To the person who double parked on Kingston and got a ticket!! I applaud the cops for giving out that ticket.. double parking on Kingston became so out of hand, you cant drive normaly its like an obstacle course, and especially when a school bus or city bus or truck have to get thru and cant… and to top it off , when they are double parked behind another double parked car and back up to leave they almost hit people who are trying to cross the street like normal people!
If you feel the need to double park…. do it on a side street, where it doesnt really affect the flow of traffic or kids crossing the streets.

If they make one mistake on your ticket and you can prove it, for example they arent allowed to abbreviate, like x-walk for cross walk, or if the name of street is wrong, like Empire Ave… or the type of car is wrongly checked off, year , color, etc.

What I would like to see implemented in CH like they have in towns out of city, is markers on the side streets where one can park in between those markers, because some people just take up 2 two parking spaces, and on a block that can handle 100 cars on a side there are like 50 only.

Okay, let’s talk about all those people who "when they are double parked behind another double parked car and back up to leave they almost hit people who are trying to cross the street like normal people!" Hello….crossing in the middle of the street is extremely dangerous. Unfortunately, here in the Heights it’s become normal and "a right." For the record, I don’t double park, cross in the middle of the street (all of us careful drivers still don’t have eyes in the back of our heads nor can we stop on a dime), or back into one way streets and I do use my seatbelt and insist that my passengers do also. We all need to wake up and be careful and realize that not everything is an emergency when we drive. Getting there safely is more important. Let us all teach our kids of ALL ages to be careful when they drive or walk.
It’s been said before, but it is worth repeating: no one should feel that arresting a Yid for such a thing can be justified. We must have ahavas yisroel for each other and be concerned when such things happen r"l. The only question is what can we do to prevent future occurrences?

2. I grew up "out of town" which is in the United States of America. This place is the Banana Republic of Crown Heights where you can do anything you want as long as you get away with it, and that includes the cops.
I’m sick of people who own businesses and scam the government, having checks made out to "Cash" passed up and down Kingston Ave. until the bank account is closed, and especially POLICE who routinely BREAK the laws they are supposed to enforce!!

I am from out of town and was double parked on Carrol St. I had missed the 12-1:30 street cleaning grace period and at 1:34 got a ticket. Since I have an out of state license plate, I was advised to ignore the ticket. I did, and I have never heard from them since (it’s been almost 6 months). I do not plan to ever pay it.

If you ever happen to be in the state of new york again with that vehicle (or with any other if the sheriff listed you as the owner), you may face charges, jail time, and the loss of your vehicle, should you be C”V spotted by a cop.

I think 2 thingsw ought to happen, like right away.
Firstly, to elect a 3 member grop who will work as police liasons, [it is important to recognise that this should NOT be the vaad, and they have "other priorities"]
the profile ot these liasons should be either, lawyers, or other respectful proffesionals, who don;t come off as idiots, thier connections should be with central booking, city hall as well as all the big wigs at the police departnent and puiblic officals.
And in the future if something like this happens, the police liasons should be notified, arive at the scene, and activate thier prolitical buttens, from city hall, albany, central booging, shelly silver and every politial avenue to ensure that a youngerman does not have to sit in jail with all the rapists and murderers.
Secondly, to hakel es haem hoanoshim noshim vitaf, get big numbers, and demonstrate [itls your right to do so in a peaceful way] with 5000 people in the front of 71 precent, it would be important that you get the press coverage, especcialy the libral papers like the times and the village voice, and establish it a) this behavior is pervasive and happens in other parts of the city or this behavior is exclusive to crown hieghts {and if it is exclusive proceed with a class action law suit. and b)start a citizens organization like that of the police liasons civil right group, and perhaps extend this organization to be recognized as a group with clout, and something the police recognize as something real, and someone they must answer to.

In closing, the website on this ticket complainet should have a place where you put in the name of the officer who wrote the ticket, and we will keep tabs on which officers are the ones who give most tickets, and we can give out a mock award to the officer who gives most tickets and give them the grand award for being the greatest anti-semite in the house.

i HAVE AN INGENIOUS SOLUTION!!. The reason the cops ticket the jews more often is because they find it easier to ticket the jews. simple as that. Every time they try to ticket someone else they actually get a nice verbal screaming. So heres how to stop that problem. Set up a hotline. a certain phone number that someone calls when he is being ticketed. Similar to the shomrim one. At the same time several loud and obnoctius Jews are dispatched to the location where the guy is being ticketed. They then peacefully scream and vent their anger at the cop. This makes the cop feel really uncomfortable and he stops ticketing Jews unfairly. Its just to much hastle for the cop. Its also perfectly legal.

It is interesting – when I drive down Nostrand Ave, there is such heavy congestion there, as there are so many cars double parked. Never do I see a cop giving a ticket. I think CH is very heavily ticketed. A few months ago when I moved in to my new apt. I double parked as there was no where else to park and unload my furniture. within a few minutes I had a ticked.

there is alot civilians dont know about how the law works and how police procedure goes. people who want to fight against the police for the police not being fair need to learn the rules first. police dont need to listen to your explainations, or give u a chance to move, you can be sitting in the car, and if u get in his way from him doing his job its Obstructing Governmental Authority, go read the penal law and the administrative code and the vehicle traffic law, then protect yourselfs with your own actions

If there is a law stating no double parking then he should have not parked in that location. People only want the police to enforce the laws that others break. If the officxer was no tied up arresting him for a law he knew he was breaking they would be able to spend more time fighting other crimes. Obey the traffic laws.

If the officer had an ounce of decency or common sense he would know that when an out of town car is unloading, he should not waste time ticketing, when he should be using that time to catch real criminals (in this case dangerous traffic offenders or car thieves). A warning or a reminder was all the driver deserved if he was indeed breaking a law by unloading.

No double parking means NO double parking. It doesn’t mean, "No double parking unless you are Jewish." Most of the comments I have read here are ludicrous! This gentleman broke the law by double parking and then tried to block the officer’s way. While the officer was undoubtedly arrogant and rude, the double-parker obvioulsy thought he was above the law. And some of the people commenting on this site are talking about staging riots and protests to protect someone who broke the law? Get real, get a life, get over it and move on!!!!!!!!
