Day 20: Final Day of the Shomrim Six Trial

After a month of long and drawn out court proceedings in which six Crown Heights men, who volunteer in Shomrim, were charged with a crime, the trial finally draws close to an end. Last week Wednesday the prosecution rested after calling its 9th witness.

Today, Tuesday closing arguments will conclude and this will be the last day to be able to come and show your support.

Thursday the defense announced that it will not be calling any witnesses. “We feel the prosecution has done a phenomenal job is proving the innocence of the Shomrim Six” said a source close to the trial.

The community is invited and asked to come attend the trial proceeding to show support.

The trial starts at around 10:00am and goes on through 5:00pm with an hour break for lunch at 1:00pm.

Trial commences in 320 Jay Street, which is the Brooklyn Supreme Court in downtown Brooklyn, on the 2nd floor in the Ceremonial Room 1. The easiest way to get there is by subway, Click Here to see the Google map and see the nearby train stations.

The courthouse is located in downtown Brooklyn, a short 20 minute trip, the best trains to take is the number 3 or 4 train to Borough Hall. Check out this Google map link for a suggested route.

    Instead of just commenting on this website, people should bombard every one of the Shmirah group involved in this with phone calls demanding they withdraw the case.
    If the community had a backbone, there would be picket lines of protest infront of their homes and businesses, their children would be sent home from school, and they themselves not be allowed into any neighborhood shul. That’s what would happen in Williamsburg – and then something like this (maasering/city courts) wouldn’t happen again too fast.

Where are the voices of the community council? beit din? rabbanim? rabbis? teachers? students? parents? fellow jews? during this stressful and DISGUSTING battle between jews. I dont think there is one person in crown heights who hasnt seen atleast one shomrim member patrolling our streets each time they step out into the street. I have never seen such dedication in any other country I have lived in. How is it that we now do nothing in return for them? I would love the community to arrange a rally in support of these shomrim so that I can attend and say thank you to them for all the years and hours they have volunteered to keep me and my family safe. “PLEASE WAKE UP CROWN HEIGHTS” and PLEASE whoever has the power to make this happen please MAKE IT HAPPEN.     I opened the court room door quietly almost afraid to be seen, to my present surprize it was full of lubavichers who had come to support shomrim. honestly i didnt go for that i went for the video i heard was going to be played.

    see over the past 2 years and more often now i have seen on many of the hate sites that there is this “Video” that proves the aggression and hate that shomrim have to the tzfatim and proves that they went into 749 with the intent to hurt the bocherim.

    now if only i could show you this video.. its something that you must see for yourself (it may be show again and again in court its worth going to watch) it doesnt show not one of the allegations is shows only the opposite, its shows shomrim getting pushed and pulled and glasses being torn off their faces.

    But perhaps, just perhaps the Vaad Hakahal, along with Huebener, is instigating all this? Perhaps ? Perhaps it may be why their silence is deafening. Vaad website endorses Shmira and Huebener claims to be their attorney.

    I very much doubt that they will come forth in defense of these 6 young fellows.

    My husband refused to vote in this sham “election” but we did take heart that the Fishel Brownstein we know personally is a mentsch. We hoped he would be as ethical as we always thought him to be & that he would put an end to the corruption here. Now we see he is totally weak & useless.     I don’t live in CH though my family does and my heart is with them during this trying time.
    Wake up women……..wake up mothers and take back your community before there’s nothing left to take back but the memories of what once was.     I think many people in the community would agree with you, including some more enlightened men. However, the by-laws of the Vaad/CHJCC do not allow for women to run. As a matter of fact, we can’t even vote! (I fail to see how it can be Constitutional. Wonder what would happen if THAT went to court??)

    I have one idea. If all the women went on strike (no laundry, shopping, cooking etc) maybe that would push our husbands into making changes. Of course, Esther’s Deli & Mermelsteins would benefit, but that’s OK, they need parnassah too.

    All joking aside, there needs to be major changes. We are still living in a feudal, discriminatory era where we women aren’t even second-class citizens. If we owned goats & chickens, they would get more respect.

    LADIES IN THE COMMUNITY: Apart from a few of us (& I think most are related to the defendants) hardly any women have been. Most of the spectators are young men & family members. A few more “older” ladies (like yours truly) will look good to the Court. And if nothing else, you get to hear the shmutz involving some of our Community Council members & their puppeteers. Maybe your husbands will think twice next election if this is how our Vaad busies itself.

    This case is an eye-opener. This morning’s proceedings were hilarious: I think the judge has a real sense of humor! Some of his one-liners had us all in stitches, esp. when there was some confusion over pronouncing a defendant’s name; he got it right, I believe, better than the Jewish attorney! And he pronounced Chanukah like a pro. The court officers are extremely polite & pleasant. They keep order with a smile & a positive manner.

    I was pleased to see the public places were very well filled with supporters of justice & truth (ie well-wishers for the Shomrim Six.) Once again, the video was played (in part) & that in itself makes this layperson question why there is even a trial. Maybe the thought of a $114 MILLION civil case is behind it??

    I don’t know how much I can “report” of what went on, but if you want to see backtracking, evasions, & …let’s just say, distortions of truth, not to mention numerous Aveiras all under pompous & self-righteous “sincerity”, then come to court. Free entertainment & a real birds-eye view of the justice system.

    I heard over shabbos that the ada’s david weiss and david weingart built their case using “facts” from the hate site chabad.info,and the moisser attorney paul huebner. I heard that they even went so far as to present a picture into evidence that claimes that a shomrims members arm and shoulder that displayes a shomrim patch is another shomrims members 5 foot leg, that was kicking a missianist, is this true? If was were the prosecutors I would be embarrased to even show up in court after something like that.

    I am really curious, I don’t live in Crown Heights – though within the USA. I have just stumbled by accident on your site, and it’s rather strange – this entire story from beginning to end!

    How is it possible for these six individuals to be tried in court – according to the versions stated here, on total “fabrication and propaganda”? It would seem logical, if, as you say, that they were the “victims” instead of the “perps”, for one or two, or maybe even three to somehow be arrested and charged with a crime, but SIX??? How is a DA and all his guys able to bring a case against SIX to court without any “real” evidence?! If there is more here than you’re willing to share, then it’s time you tell the whole story, not part of it.
    I know our justice system is terribly flawed – but six guys just don’t get arrested and charged with a crime “by accident”.

    The best way forward for the Shomrim is to file the exact same charges against the Tzfati guys who in fact were the ones who assaulted and attacked the victims: the Shomrim, and Yitzy Vail, and the bachur who was to be thrown out of his room. IN OTHER WORDS YOU GUYS NEED TO GO ON THE OFFENSE!!! Also you can bring charges against Huebner for filing a frivolous law suit. They should be sued for double what Huebner is suing them. It might also pay to get Rabbi Wilshansky of Tzfas, who is reasonable, and Rabbi Shvai, to tell these Tzfatim to back off. It is very sad that Huebner, who I know, is doing this. He should know better and he should have more common sense.

    It’s called due diligence, something the overloaded NYPD and Brooklyn DA failed to do. They took the “victims’” word for it, and now it’s pretty much blowing up in their faces. Unfortunately, it happens more often than you’d think, no matter how many “perps” there are.

    Puzzled, I’m an intelligent, educated woman (not an attorney, however) & it is clear this is a case brought merely to fulfill Mr. Huebner’s personal agenda.

    I heard he has never won a case. If a criminal conviction is awarded, he has a green light to go after the $114 MILLION lawsuit he’s persuaded these illiterate, ignorant, and downright stupid Tsfatim to go after. Then if he is entitled to 30%…well, you do the math!

    My guess is as the previous poster said: very little research was done by the DA, the case presented to the Grand Jury was probably full of holes, & even the jury is having a hard time following it all. It’s a farce.

    Who was it who said a Grand Jury can indict a ham sandwich? Well, I have seen they can. And do.

    Throw Heubner out of 770 the next time he shows up, for the chillul hashem and all the trouble he’s caused, just so he can line his pockets with a civil suit after the criminal case is done and goes in his favor. I don’t believe the Tzfati’s would have gone this far if not for the MESHUMAD Heubner instigating them for his own selfish reasons, of course. If you want to restore some peace, throw the MESHUMAD Heubner out of 770 and make him an example for any future wannabe MOISRIM.

    I heard from a quite trustworthy source that it’s known to the Hanhala of the Yeshiva in Tzfas that a number of accepted students there DO HAVE mental problems – which may lead, i’d say, to uncontrolled actions…

    Would anyone know anything about?

    If these “special students” are the ones who come to learn at 770, then, who knows, we can start to assess the root of the problem…

  • One small legal question

    Are these Tzfatim legally allowed to be in the states? (I mean, if they’re not legally allowed to be here, are they legally allowed to make a court case against citizens?) I don’t know how these legal things work, but if someone is here, let’s say on a student visa, are they granted the same rights as an American citizen? If not, why can’t we send them packing back to their country?

    So, in essence, you are suggesting open season on tourists, foreign students, illegal immigrants, and “aliens” in general? An American citizen can rob, beat, murder, maime, and otherwise inflict harm on a non-citizen, and as long as it is on the shores of the United States, it’s okay?

    Does that sound in line with the constitution? Are you kidding me???

    My comment is in no way related to the Shomrim trail and doesn’t suggest in any way that they are guilty of such behavior. I fully support the Shomrim.
