Again, and Again: Another Home Burglarized on Friday Night

First it was just the residents, now even the police are frustrated. Just 12 days ago we reported on the arrest of a suspect tied to a string of burglaries that were occurring on Friday night. Just three days later, the suspect was released without bail. This weekend, a Crown Heights resident interrupted a burglary taking place in his home.

The latest incident occurred on Friday night at around 4:00am on Lincoln Place off Albany Avenue.

The homeowner described to CrownHeights.info how the incident unfolded:

Shabbos [Friday] night I woke up shortly after 4:00am and couldn’t fall back asleep; rather than lie in bed, I thought I would go downstairs and learn something.  I got dressed, but was still barefoot, and went downstairs.

Once I was downstairs I saw our cat staring at something down the basement stairs, so I went down to the basement to see what the cat was staring at, but didn’t see anything unusual there.

Then I felt cold air and noticed that the basement window was open, which was unusual.  I looked through the window and saw the bottom of someone’s feet.

At that point I thought it was a homeless person who was trespassing, so I called through the window “what are you doing, get out of here.”  I then heard a small clatter, as if he was trying to pack some items away and leave quickly by climbing over my front stoop, so I opened my front door to see who it was.

At that point he dropped what I recognized to be a silver dish that I use under my Kiddush cup, and I then realized he had stolen it from the house.

The burglar, who was described a black male, of thin build, approximately 5′ 9″ tall and ‘older,’ had a bicycle waiting. As he was about to hop on and flee, the homeowner confronted him and tried to restrain him. The burglar then turned to him and said “I have a knife, I’ll kill you.”

The homeowner told CrownHeights.info that he did not see a knife, but thought better than to risk being harmed. “since he was not in the house and it was only property that he had taken, and it was Shabbos, I did not think it was worth risking it, so instead I screamed ‘Police Police,’ but no neighbors heard,” he said.

He watched as the burglar fled down Lincoln Place, then turned onto Albany Avenue towards S. Johns Place.

As the homeowner returned to his house he noticed that the metal security bars that were covering the basement window had been pried off. He then put on shoes and made his way to the 77th Precinct and reported the burglary, and by the time he returned home police officers were there waiting for him to take a report.

Cops wanted to call for an evidence collection team, but at the request of the homeowner they waited till Shabbos ended, and only then they arrived to collect finger prints and DNA swabs.

In the burglars rush to flee he had dropped a sterling silver Challah (bread) knife, as well as some sort of belt that was made of plastic. Among the items taken were two cell phones, a silver Kiddush cup and plate, around $400 in cash as well as checks, credit and debit cards as well as ID cards including a drives license.

On November 5th we reported that the 71st Precinct had made an arrest in connection with the many burglaries that occurred. One Rudolph Boseman, 55, was taken into custody and in his possession was a cell phone which was stolen from a home that was robbed that weekend. Boseman was charged with possession of stolen property.

Court records show that the District Attorney had requested bail of ‘only’ $1000 which he was not able to post. Three days later records show that

released him on his own recognizance. Just one month ago the Brooklyn Eagle reported Judge Pickett refused to revoke bail for a man accused assault and weapons possession after he had made threatening phone calls to a trial witness, the judge said that phone calls was not sufficient evidence to revoke bail.

CrownHeights.info was in touch with the 71st Precinct, who notified about the burglary by Shomrim, and are just as frustrated as we are, given Boseman’s history and past record that a judge would see fit to not only release him, but without bail as well.

It isn’t clear that Mr. Boseman is the one behind the latest burglary, but evidence suggests that it was the same person behind all the other burglaries.

We reached out to the Brooklyn District Attorney’s office for comment and a spokesperson said that in these cases bail is entirely up to the judge, as well as the decision to take a defendants past into account. Being that this cases top charge was only a misdemeanor it isn’t uncommon for a defended to be released on his own recognizes” the spokesperson said.

    they only put officers on kingston when everyone is going home from shul, what about having cops 24/7 what about having them from utica to nostrand from st john to maple st not just on kingston where most people will see them!!!

    Again, as I have stated on this site before. There is a major problem with the criminal justice system and the people who serve as judges. There is no valid legal reason that this person should have been allowed back on the streets just based on his own recognizance. Well I know that the Judge is being politically correct and liberal by allowing the concept that criminals have more rights then the victims in any criminal action. About time she should be fired!!!!!!!This attitude stems from the Bloomberg regime. Any doubt, not to long ago a women police officer had to kill a convicted seven time major crime felon who tried to kill her partner. He had been just arrested for the umpteenth time and the judge let him off with a slap on the hand and told him to see a shrink because he (the criminal) had the right to be on the streets. But politically right has perverted justice; i. e., it has occurred where a criminal broke into a house armed with a deadly weapon and was shot by homeowner to protect his family, the criminal could sue the home owner and win and take every penny the owner had because the owner’s action in protecting his family deprived the criminal of the opportunity to practice his profession.

    p. s. the homeowner was lucky that the criminal just ran and did not attack him–because who know what could have occurred. It is better just to let him go and call 911 unless you have a 45 and are willing to use it.

    next time allow the evidence collection team to do their work right away. the more one waits the harder to collect prints….dont be frum on someone else’s cheshbon….especially when there is no mokur…it is pekuach nefesh.

      I did not tell the police not to come and take finger prints on Shabbos. I was told there was a separate evidence collection team that would come, and I responded about which times we would not be home because we would be at shul, and based on that, the evidence collection team came right after Shabbos.

    Are there practical ways for the public to contact this judge? Is there a fax number or an email? If there is, pls post, and hopefully people will take a few minutes to make their voices heard, so that when this guy is hauled back into court again, the judge will not release him.

    I’m telling you…it is the smells of cholent mit kugel that attracts those guests….cold meats on shabbos morning will remedy this ugly situation . Shabbos or not, get the police to take prints..don’t wait…that’s foolish!

    Is someone allowed to call police or shomrim in such a situation on Shabbos since he person could be a threat to other households?

    Windows can be secured somewhat with nails that slide into holes drilled into the window frame.
    A search online shows that Boseman has a court date in January.

    yes you are. If there is a safek of pikuach nefesh you may. When a burglar is in a home there is no telling what he is capable of doing, therefore rending the situation safek pikuach nefesh. if you see someone breaking into a car you may not call on shabbos. for that is property and for that you may not be mechalel shabbos.

    if the burglar has left the house then it’s assur to call cuase it’s not pikuach nefesh (thats why the houseowner walked to the police station) if he’s still in you’re house it’s permited.

    Can the homeowner pick. Boserman from a line up… Judge picket is a political liberal hack she dosent care about you and I don’t know why you would expect her to care…. If the Muslims would have caught this guy that would have solved this really fast with quick one two chop… Since we don’t have that Halacha we have to help the police do their job, pray harder and maybee get a gun because as long as the sun has not risen… Remember this guy was insisting that Hejaz a knife and knows how to use it…

    Let Boseman “visit” his friendly judge during the night. One good turn deserves another & he can repay her kindness by relieving HER of some of her treasured possessions.

    What a racist! I really wonder if she would have the same verdict if it were a white person, or even better yet, a Jew???
    After I woke up one night to find a black man in my bedroom doorway, going through my sons jacket pockets (and taking his wallet), I was told that if the burglar had a weapon, and a screwdriver is considered a weapon as well, I would have been legally allowed to shoot him. So, the solution is; forget judges like picket etc. have your own gun, and if you are burglarized and you catch the fiend in the act, do us all a favor, save the taxpayers money, simply shoot to kill and just plant a screwdriver or a knife in his hands. You will be blessed by the rest of the community, and avoid the expense of feeding this animal while in custody.

    Acc 2 American law burglers have rights meanin if u shoot him & u dont kill him he could press charges against u. Thats how sick it is the only way 2 get out of it is 2 kill him, 1nce dead then nothing can happen no charges pressed. similar 2 comment # 31. I dont think in Lakewood they have these issues boro park 4 sure not & definetly in Willi, they would kill him.
